A BILL
To withhold Federal highway funds from States that provide
driver’s licenses or identification cards to aliens who are
unlawfully present in the United States, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Red Light Act’’.

SEC. 2. WITHHOLDING OF FUNDS FOR PROVIDING IDENTI-

FICATION CARDS TO CERTAIN ALIENS.

(a) IN GENERAL.—Chapter 1 of title 23, United
3
States Code, is amended by adding at the end the fol-
4
lowing new section:
5
‘‘§ 171. Withholding of funds for providing identifica-
6
tion cards to certain aliens
7
‘‘(a) WITHHOLDING
OF FUNDS
FOR NONCOMPLI-
8
ANCE.—For fiscal year 2020 and each fiscal year there-
9
after, the Secretary shall withhold 100 percent of the
10
amount required to be apportioned under each of sections
11
104(b)(1), 104(b)(3), and 104(b)(4) of this title to any
12
State that is described in subsection (b).

‘‘(b) STATE DESCRIBED.—A State described in this
14
subsection is a State that has enacted a law that allows
15
the State to provide a driver’s license or other identifica-
16
tion card to an alien who is unlawfully present in the
17
United States.

‘‘(c) EFFECT OF WITHHOLDING FUNDS.—
19
‘‘(1) Any funds withheld under subsection (a)
20
from apportionment to any State shall remain avail-
21
able until the end of the fiscal year for which the
22
funds are authorized to be appropriated.

‘‘(2) If, before the last day of the period for
24
which funds withheld under subsection (a) from ap-
25
portionment are to remain available for apportion-

ment to a State under paragraph (1), the State
1
meets the requirement of subsection (b), the Sec-
2
retary shall, on the first day on which the State
3
meets the requirement, apportion to the State the
4
funds withheld under subsection (a) that remain
5
available for apportionment to the State.

‘‘(d) IDENTIFICATION CARD DEFINED.—The term
7
‘identification card’ means a personal identification card,
8
as defined in section 1028(d) of title 18, United States
9
Code, issued by a State.’’.

(b) CLERICAL AMENDMENT.—Chapter 1 of title 23,
11
United States Code, in the table of contents is amended
12
by adding at the end the following:

‘‘171. Withholding of funds for providing identification cards to certain aliens.’’.
