To amend the Immigration and Nationality Act to eliminate
the Optional Practical Training Program, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Fairness for High-
4
Skilled Americans Act of 2019’’.

SEC. 2. ELIMINATING THE OPTIONAL PRACTICAL TRAINING
6
PROGRAM.

Section 274A(h) of the Immigration and Nationality
8
Act (8 U.S.C. 1324a) is amended by adding at the end
9
the following:

EMPLOYMENT
AUTHORIZATION
FOR

ALIENS NO LONGER ENGAGED IN FULL-TIME STUDY

IN
THE
UNITED
STATES.—Notwithstanding any

other provision of law, no alien present in the United
4
States
as
a
nonimmigrant
under
section
5
101(a)(15)(F)(i) may be provided employment au-
6
thorization in the United States pursuant to the Op-
7
tional Practical Training Program, or any such suc-
8
cessor program, without an express Act of Congress
9
authorizing such a program.’’.
