background check conducted by the National Instant Criminal Back-
ground Check System determines that a person may not receive a fire-

A BILL
To amend the NICS Improvement Amendments Act of 2007
to provide notification to relevant law enforcement agen-
cies in the event that a background check conducted
by the National Instant Criminal Background Check Sys-
tem determines that a person may not receive a firearm,
and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Unlawful Gun Buyer
2
Alert Act’’.

SEC. 2. NOTIFICATION TO LAW ENFORCEMENT AGENCIES
4
OF PROHIBITED PURCHASE OR ATTEMPTED
5
PURCHASE OF A FIREARM.

(a) IN GENERAL.—Title I of the NICS Improvement
7
Amendments Act of 2007 (34 U.S.C. 40911–40917) is
8
amended by adding at the end the following:

‘‘SEC. 108. NOTIFICATION TO LAW ENFORCEMENT AGEN-
10
CIES OF PROHIBITED PURCHASE OR AT-
11
TEMPTED PURCHASE OF A FIREARM.

‘‘(a) IN GENERAL.—In the case of a background
13
check conducted by the National Instant Criminal Back-
14
ground Check System pursuant to the request of a li-
15
censed importer, licensed manufacturer, or licensed dealer
16
of firearms (as such terms are defined in section 921 of
17
title 18, United States Code), which background check de-
18
termines that the receipt of a firearm by a person would
19
violate subsection (g) or (n) of section 922 of such title,
20
including any such case in which the determination is
21
made after 3 business days have elapsed since the licensee
22
contacted the System and a firearm has been transferred
23
to that person, the System shall notify the law enforce-
24
ment agencies described in subsection (b) of this section.

‘‘(b) LAW ENFORCEMENT AGENCIES DESCRIBED.—

The law enforcement agencies described in this subsection
2
are the law enforcement agencies that have jurisdiction
3
over the location from which the licensee contacted the
4
system and the law enforcement agencies that have juris-
5
diction over the location of the residence of the person for
6
which the background check was conducted, as follows:
7
‘‘(1) The field office of the Federal Bureau of
8
Investigation.
9
‘‘(2) The local law enforcement agency.
10
‘‘(3) The State law enforcement agency.’’.
11
(b) CLERICAL AMENDMENT.—The table of contents
12
of such Act (34 U.S.C. 10101 note) is amended by insert-
13
ing after the item relating to section 107 the following:
14
‘‘108. Notification to law enforcement agencies of prohibited purchase or at-
tempted purchase of a firearm.’’.
