IN THE HOUSE OF REPRESENTATIVES

Mr. BLUMENAUER introduced the following bill; which was referred to the
Committee on Energy and Commerce, and in addition to the Committee
on the Judiciary, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall within
the jurisdiction of the committee concerned
A BILL
To prevent Federal agencies from interfering with the
marijuana policy of States.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘State Cannabis Com-
4
merce Act’’.

SEC. 2. STATES MARIJUANA POLICY.

(a) DEFINITIONS.—In this Act:

(1) FEDERAL
AGENCY.—The term ‘‘Federal
1
agency’’ has the meaning given the term ‘‘agency’’
2
in section 551 of title 5, United States Code.
3
(2) MARIJUANA.—The term ‘‘marijuana’’ has
4
the meaning given the term ‘‘marihuana’’ in section
5
102 of the Controlled Substances Act (21 U.S.C.
6
802).

(3) STATE.—The term ‘‘State’’ means any
8
State, the District of Columbia, any territory or pos-
9
session of the United States, or any Indian tribal
10
government.

(b) PROHIBITIONS.—No funds authorized or appro-
12
priated by Federal law, and none of the funds in any trust
13
fund to which funds are authorized or appropriated by
14
Federal law, shall be expended to prevent any State from
15
implementing any law of the State that—
16
(1) authorizes the use, distribution, possession,
17
or cultivation of marijuana on non-Federal land in
18
the State; or
19
(2) authorizes the transportation of marijuana
20
across the border of the State if—
21
(A) the State from which the marijuana is
22
transported has a State law described in para-
23
graph (1); and
