To provide temporary impact aid construction grants to
eligible local educational agencies, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Impact Aid Infrastruc-
4
ture Act’’.
5
SEC. 2. IMPACT AID CONSTRUCTION GRANTS AUTHORIZED.
6
(a) FUNDING AND SUNSET.—

(1) AUTHORIZATION

this Act.

(2) SUPPLEMENTAL
FUNDING.—The amount
3
authorized under paragraph (1) shall be in addition
4
to any amounts authorized to be appropriated or
5
otherwise made available to carry out section 7007
6
of title VII of the Elementary and Secondary Edu-
7
cation Act of 1965 (20 U.S.C. 7707).
8
(3) AVAILABILITY
OF
FUNDS.—Any amounts
9
appropriated under subsection (a)(1) shall remain
10
available until expended.
11
(4) SUNSET.—The authority to award grants
12
under this Act shall expire at the end of the 3-year
13
period beginning on the date on which funds are
14
first made available to award a grant under this Act.
15
(b) RESERVATION FOR MANAGEMENT AND OVER-
16
SIGHT.—From the funds appropriated under subsection
17
(a)(1), the Secretary may reserve up to half of 1 percent
18
for management and oversight of the activities carried out
19
with those funds.
20
(c) FORMULA GRANTS.—From 40 percent of the
21
funds appropriated under subsection (a)(1) and not re-
22
served under subsection (b), the Secretary shall make pay-
23
ments in accordance with section 7007(a) of the Elemen-

(d) COMPETITIVE GRANTS.—From 60 percent of the
3
funds appropriated under subsection (a)(1) and not re-
4
served under subsection (b), the Secretary—
5
(1) shall award emergency grants in accordance
6
with section 7007(b) of the Elementary and Sec-
7
ondary Education Act of 1965 (20 U.S.C. 7707(b)),
8
except as otherwise provided in this Act; and
9
(2) may award modernization grants in accord-
10
ance with section 7007(b) of the Elementary and
11
Secondary Education Act of 1965 (20 U.S.C.
12
7707(b)), except as otherwise provided in this Act.

SEC. 3. ELIGIBILITY.
14
(a) ELIGIBILITY FOR EMERGENCY GRANTS.—
15
(1) IN GENERAL.—For purposes of receiving an
16
emergency grant under section 2(d)(1) of this Act,
17
in addition to a local educational agency that meets
18
the eligibility requirements for the award of such a
19
grant under any of subparagraphs (A), (C), or (D)
20
of section 7007(b)(3) of the Elementary and Sec-
21
ondary
Education
Act
of
1965
(20
U.S.C.
22
7707(b)(3)), a local educational agency that meets
23
the requirements described in paragraph (2) of this
24
subsection (without regard to whether the agency

meets the requirements of such subparagraphs (A),

(C), or (D)), shall be eligible for such a grant.

(2) REQUIREMENTS.—A local educational agen-
3
cy meets the requirements of this paragraph, if such
4
agency has—
5
(A) a total taxable assessed value of real
6
property that may be taxed for school purposes
7
of less than $100,000,000; or
8
(B) an assessed value of real property per
9
student that may be taxed for school purposes
10
that is less than the average of the assessed
11
value of real property per student that may be
12
taxed for school purposes in the State in which
13
the local educational agency is located.

(b) ELIGIBILITY FOR MODERNIZATION GRANTS.—
15
(1) IN GENERAL.—For purposes of receiving a
16
modernization grant under section 2(d)(2) of this
17
Act, in addition to a local educational agency that
18
meets the eligibility requirements for the award of
19
such a grant under any of subparagraphs (B), (C),
20
or (D) of section 7007(b)(3) of the Elementary and
21
Secondary Education Act of 1965 (20 U.S.C.
22
7707(b)(3)), a local educational agency that meets
23
the requirements described in paragraph (2) of this
24
subsection (without regard to whether the agency

and Secondary Education Act of 1965 (20 U.S.C. 7713).

SEC. 4. INAPPLICABILITY OF CERTAIN PROVISIONS.
19
Clauses (i) and (vi) of paragraph (5)(A) of section
20
7007(b) of the Elementary and Secondary Education Act
21
of 1965 (20 U.S.C. 7707(b)) shall not apply to grants
22
made under section 2(d).
