What This Bill Does
This bill changes the chemical security rules that apply to certain propane storage facilities. It removes some propane storage facilities from having to follow certain chemical security standards set by the Department of Homeland Security.

SECTION 1. EXCLUSION OF CERTAIN PROPANE STORAGE

FACILITIES FROM CERTAIN CHEMICAL SECU-
2
RITY STANDARDS UNDER THE DEPARTMENT
3
OF HOMELAND SECURITY.

(a) IN GENERAL.—Title XXI of the Homeland Secu-
5
rity Act of 2002 (6 U.S.C. 621 et seq.) is amended—
6
(1) in paragraph (4) of section 2101—
7
(A) in subparagraph (D), by striking ‘‘or’’
8
after the semicolon at the end;
9
(B) in subparagraph (E), by inserting ‘‘or’’
10
after the semicolon at the end; and
11
(C) by adding at the end the following new
12
subparagraph:
13
‘‘(F) subject to section 2110, a facility
14
that stores propane for sale to or use by a
15
dwelling (as such term is defined in section
16
802(b) of the Fair Housing Act (42 U.S.C.
17
3602(b))), sale to or use in agricultural produc-
18
tion (as such term is defined in section 4279.2
19
of title 7, Code of Federal Regulations), or sale
20
to or use by small business concerns (as such
21
term is described under section 3 of the Small
22
Business Act (15 U.S.C. 632)) that are located
23
in rural areas (as such term is defined in sec-
24
tion 520 of the Housing Act of 1949 (42
25
U.S.C. 1490));’’; and

(2) by adding at the end the following new sec-

‘‘SEC. 2110. DETERMINATION RELATING TO CERTAIN PRO-

PANE STORAGE FACILITIES.

‘‘If the Secretary makes a determination that a pro-
5
pane storage facility does not satisfy the requirements of
6
an excluded facility, the Secretary shall—
7
‘‘(1) submit to Congress a report relating there-
8
to; and
9
‘‘(2) provide notification to the owner or oper-
10
ator of such propane storage facility relating there-
11
to.’’.

(b) CLERICAL AMENDMENTS.—The table of contents
13
in section 1(b) of the Homeland Security Act of 2002 is
14
amended by inserting after the item relating to section
15
2109 the following new item:

‘‘Sec. 2110. Determination relating to certain propane storage facilities.’’.
