A BILL
To amend title 10, United States Code, to improve policy
and data collection in connection with personnel tempo
of the Armed Forces and the United States Special Oper-
ations Command, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Service Member and
4
Family Operational Tempo Relief Act of 2019’’.

SEC. 2. PERSONNEL TEMPO OF THE ARMED FORCES AND

THE UNITED STATES SPECIAL OPERATIONS

COMMAND DURING PERIODS OF INAPPLICA-
3
BILITY OF HIGH-DEPLOYMENT LIMITATIONS.

(a) IN GENERAL.—Section 991(d) of title 10, United
5
States Code, is amended—
6
(1) by inserting ‘‘(1)’’ before ‘‘The Secretary’’;
7
and
8
(2) by adding at the end the following new
9
paragraph:

‘‘(2)(A) Whenever a waiver is in effect under para-
11
graph (1), the member or group of members covered by
12
the waiver shall be subject to specific and measurable de-
13
ployment thresholds established and maintained for pur-
14
poses of this subsection.

‘‘(B) Thresholds under this paragraph may be appli-
16
cable—
17
‘‘(i) uniformly, Department of Defense-wide; or
18
‘‘(ii) separately, with respect to each armed
19
force and the United States Special Operations
20
Command.

‘‘(C) If thresholds under this paragraph are applica-
22
ble Department-wide, such thresholds shall be established
23
and maintained by the Under Secretary of Defense for
24
Personnel and Readiness. If such thresholds are applicable
25
only to a separate armed force or the Under States Special

Operations Command, such thresholds shall be established
1
and maintained by the Secretary of the Army, the Sec-
2
retary of the Navy (other than with respect to the Marine
3
Corps), the Secretary of the Air Force, the Commandant
4
of the Marine Corps (with respect to the Marine Corps),
5
and the Commander of the United States Special Oper-
6
ations Command, as applicable.

‘‘(D) In undertaking recordkeeping for purposes of
8
subsection (c), the Under Secretary shall, in conjunction
9
with the other officials and officers referred to in subpara-
10
graph (C), collect complete and reliable personnel tempo
11
data of members described in subparagraph (A) in order
12
to ensure that the Department, the armed forces, and the
13
United States Special Operations Command fully and
14
completely monitor personnel tempo under a waiver under
15
paragraph (1) and its impact on the armed forces.’’.

(b) DEADLINE FOR IMPLEMENTATION.—Paragraph
17
(2) of section 991(d) of title 10, United States Code, as
18
added by subsection (a), shall be fully implemented by not
19
later than March 1, 2020.
