A BILL
To require the Administrator of the Environmental Protec-
tion Agency to designate per- and polyfluoroalkyl sub-
stances as toxic pollutants under the Federal Water Pol-
lution Control Act, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Clean Water Standards
4
for PFAS Act of 2019’’.

SEC. 2. PFAS DESIGNATION, EFFLUENT LIMITATIONS, AND

PRETREATMENT STANDARDS.

(a) IN GENERAL.—Not later than 30 days after the
3
date of enactment of this Act, the Administrator of the
4
Environmental Protection Agency shall revise the list of
5
toxic pollutants described in paragraph (1) of section
6
307(a) of the Federal Water Pollution Control Act (33
7
U.S.C. 1317(a)) to add per- and polyfluoroalkyl sub-
8
stances to such list, and publish such revised list, without
9
taking into account the factors listed in such paragraph.

(b) EFFLUENT STANDARDS.—As soon as practicable
11
after the date on which the revised list is published under
12
subsection (a), but not later than January 1, 2022, the
13
Administrator shall publish in the Federal Register efflu-
14
ent standards under section 307(a)(2) of the Federal
15
Water Pollution Control Act (33 U.S.C. 1317(a)(2)) for
16
substances added to the list of toxic pollutants pursuant
17
to subsection (a) of this section, in accordance with sec-
18
tions 301(b)(2)(A) and 304(b)(2) of such Act.

(c) PRETREATMENT STANDARDS.—Not later than
20
January 1, 2022, the Administrator shall promulgate
21
pretreatment standards for per- and polyfluoroalkyl sub-
22
stances under section 307(b) of the Federal Water Pollu-
23
tion Control Act (33 U.S.C. 1317(b)).
