To amend the Public Health Service Act to revise the amount
of minimum allotments under the Projects for Assistance
in Transition from Homelessness Program.

SECTION 1. SHORT TITLE.

This Act may be cited as the ββPATH Fairness Act

of 2019ββ.

Section 524 of the Public Health Service Act (42

U.S.C. 290ccβ24) is amended to read as follows:
5
ββSEC. 524. DETERMINATION OF AMOUNT OF ALLOTMENT.
6
ββ(a) DETERMINATION UNDER FORMULA.βSubject
7
to subsection (b), the allotment required by section 521
8
for a State for a fiscal year is the product ofβ
9
ββ(1) an amount equal to the amount appro-
10
priated under section 535 for the fiscal year; and
11
ββ(2) a percentage equal to the quotient ofβ
12
ββ(A) an amount equal to the population
13
living in urbanized areas of the State involved,
14
as indicated by the most recent data collected
15
by the Bureau of the Census; and
16
ββ(B) an amount equal to the population
17
living in urbanized areas of the United States,
18
as indicated by the sum of the respective
19
amounts determined for the States under sub-
20
paragraph (A).

ββ(b) MINIMUM ALLOTMENT.β

ββ(1) IN GENERAL.βSubject to paragraph (2),
23
the allotment for a State under section 521 for a fis-
24
cal year shall, at a minimum, be the greater ofβ

ββ(A) the amount the State received under

section 521 for fiscal year 2019; and
2
ββ(B) $750,000 for each of the several
3
States, the District of Columbia, and the Com-
4
monwealth of Puerto Rico, and $100,000 for
5
each of Guam, the Virgin Islands, American
6
Samoa, and the Commonwealth of the Northern
7
Mariana Islands.

ββ(2) CONDITION.βIf the funds appropriated
9
for any fiscal year under section 535 are insufficient
10
to ensure that States receive a minimum allotment
11
in accordance with paragraph (1), thenβ
12
ββ(A) no State shall receive less than the
13
amount received by the State in fiscal year
14
2019; and
15
ββ(B) any funds remaining after amounts
16
are provided under subparagraph (A) shall be
17
used to meet the requirement of paragraph
18
(1)(B), to the maximum extent possible.ββ.

SEC. 3. AUTHORIZATION OF APPROPRIATIONS.

Section 535(a) of the Public Health Service Act (42
21
U.S.C. 290ccβ35(a)) is amended by striking ββ$64,635,000
22
for each of fiscal years 2018 through 2022ββ and inserting
