To require that in a notice of proposed rule making for
a new rule, the notice shall identify two rules which
the agency intends to repeal.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. REQUIREMENT TO REPEAL TWO RULES BE-
3
FORE MAKING A NEW RULE.
4
Section 553(b) of title 5, United States Code, is
5
amended—
6
(1) in paragraph (2), by striking ‘‘and’’ at the
7
end;
8
(2) in paragraph (3), by striking the period at
9
the end and inserting ‘‘; and’’; and

‘‘(4) in the case of a notice of proposed rule

making for a new rule, except in the case of a new

rule which is required by statute, an identification of
5
two rules that the agency intends to repeal, includ-

ing the date on which the agency began the rule
7
making process in order to repeal such rules.’’.
