Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. IMPROVING SAFETY AND SECURITY FOR SERVICE 1 WEAPONS USED BY FEDERAL LAW ENFORCE- 2 MENT OFFICERS. 3 (a) IN GENERAL.—Chapter 203 of title 18, United 4 States Code, is amended by adding at the end the fol- 5 lowing: 6 ‘‘§ 3064. Safety and security of service weapons used 7 by Federal law enforcement officers 8 ‘‘(a) The head of each civilian or military Federal law 9 enforcement agency shall prescribe requirements for the 10 safe locking and storage of service firearms when they are 11 not in use, to be followed by each Federal law enforcement 12 officer in that agency and each person who assists that 13 agency in its law enforcement functions, who carries a fire- 14 arm as a service weapon. The agency shall, subject to the 15 availability of appropriations, provide the appropriate 16 equipment needed to comply with those requirements to 17 each person to whom that agency’s requirements pre- 18 scribed under this subsection apply. 19 ‘‘(b) In prescribing the requirements under sub- 20 section (a) the head of each agency shall adopt the fol- 21 lowing minimum standards for safe storage and locking: 22 ‘‘(1) Officers are responsible for the safe stor- 23 age of their service firearm when not in their per- 24 sonal possession by using smart guns and smart 25 VerDate Sep 11 2014 02:14 Jun 27, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3420.IH H3420 kjohnson on DSK79L0C42 with BILLS 3 •HR 3420 IH locks, trigger locks, safes, gunlock boxes, or other 1 means approved by the agency. 2 ‘‘(2) Service firearms shall not be stored in pa- 3 trol or personally owned vehicles except for tem- 4 porary storage when at court, when other options for 5 safekeeping are not available, or if authorized by the 6 agency. 7 ‘‘(3) Any violation of the requirements con- 8 stitutes grounds for discipline, for which the agency 9 shall consider imposing minimum punishment stand- 10 ards. 11 ‘‘(c) The head of each Federal civilian or military law 12 enforcement agency shall report any loss or theft of a serv- 13 ice firearm from that agency, any law enforcement officer 14 in that agency, or any person assisting such an officer— 15 ‘‘(1) to relevant State and local law enforce- 16 ment agencies; and 17 ‘‘(2) to the Bureau of Alcohol, Tobacco, and 18 Firearms and the Federal Bureau of Investigation, 19 in order to facilitate the central availability of infor- 20 mation about the prevalence of such loss or theft. 21 ‘‘(d) The head of each civilian or military Federal law 22 enforcement agency shall take appropriate action to en- 23 sure that any person who assists that agency in its law 24 VerDate Sep 11 2014 02:14 Jun 27, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3420.IH H3420 kjohnson on DSK79L0C42 with BILLS 4 •HR 3420 IH enforcement functions and carries a firearm in the course 1 of doing so is trained in safe storage and locking practices. 2 ‘‘(e) The head of each civilian and military Federal 3 law enforcement agency shall provide written materials to 4 each Federal law enforcement officer in that agency, and 5 each person who assists that agency in its law enforcement 6 functions, who carries a firearm as a service weapon, 7 about the statistical risks of keeping a firearm at home, 8 especially if it is easily accessible. 9 ‘‘(f) There are authorized to be appropriated to carry 10 out this section, including the provision of equipment 11 under subsection (a), such sums as may be necessary.’’. 12 (b) CLERICAL AMENDMENT.—The table of sections 13 at the beginning of chapter 203 of title 18, United States 14 Code, is amended by adding at the end the following new 15 item: 16 ‘‘3064. Safety and security of service weapons used by Federal law enforcement officers.’’.
