Mr. SCHUMER (for himself, Ms. DUCKWORTH, Mrs. GILLIBRAND, and Ms.
KLOBUCHAR) introduced the following bill; which was read twice and re-
ferred to the Committee on Banking, Housing, and Urban Affairs

To require the Secretary of the Treasury to mint coins
in commemoration of the National Purple Heart Hall
of Honor.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘National Purple Heart
4
Hall of Honor Commemorative Coin Act’’.
5
SEC. 2. FINDINGS.
6
The Congress finds the following:
7
(1) The mission of the National Purple Heart
8
Hall of Honor is—

(A) to commemorate the extraordinary sac-
1
rifice of servicemembers of the United States
2
who were killed or wounded by enemy action;
3
and
4
(B) to collect and preserve the stories of
5
Purple Heart recipients from all branches of
6
service and across generations to ensure that all
7
recipients are represented.

(2) The National Purple Heart Hall of Honor
9
first opened its doors on November 10, 2006, in
10
New Windsor, New York.
11
(3) The National Purple Heart Hall of Honor
12
is colocated with the New Windsor Cantonment
13
State Historic Site.
14
(4) The National Purple Heart Hall of Honor
15
is the first to recognize the estimated 1,800,000
16
servicemembers of the United States wounded or
17
killed in action representing recipients from the Civil
18
War to the present day, serving as a living memorial
19
to their sacrifice by sharing their stories through
20
interviews, exhibits, and the Roll of Honor, an inter-
21
active computer database of each recipient enrolled.

SEC. 3. COIN SPECIFICATIONS.
1
(a) DENOMINATIONS.—The Secretary of the Treas-
2
ury (hereafter in this Act referred to as the ‘‘Secretary’’)
3
shall mint and issue the following coins:
4
(1) $5 GOLD COINS.—Not more than 50,000 $5
5
coins, which shall—
6
(A) weigh 8.359 grams;
7
(B) have a diameter of 0.850 inches; and
8
(C) contain 90 percent gold and 10 percent
9
alloy.
10
(2) $1 SILVER COINS.—Not more than 400,000
11
$1 coins, which shall—
12
(A) weigh 26.73 grams;
13
(B) have a diameter of 1.500 inches; and
14
(C) contain not less than 90 percent silver.

(3) HALF-DOLLAR
CLAD
COINS.—Not more
16
than 750,000 half-dollar coins which shall—
17
(A) weigh 11.34 grams;
18
(B) have a diameter of 1.205 inches; and
19
(C) be minted to the specifications for half-
20
dollar coins contained in section 5112(b) of title
21
31, United States Code.

(b) LEGAL TENDER.—The coins minted under this
23
Act shall be legal tender, as provided in section 5103 of
24
title 31, United States Code.

(c) NUMISMATIC ITEMS.—For purposes of section
1
5134 of title 31, United States Code, all coins minted
2
under this Act shall be considered to be numismatic items.

SEC. 4. DESIGN OF COINS.
4
(a) DESIGN REQUIREMENTS.—
5
(1) IN
GENERAL.—The design of the coins
6
minted under this Act shall be emblematic of the
7
mission of the National Purple Heart Hall of Honor.
8
(2) DESIGNATION
AND
INSCRIPTIONS.—On
9
each coin minted under this Act there shall be—
10
(A) a designation of the value of the coin;
11
(B) an inscription of the year ‘‘2021’’; and
12
(C) inscriptions of the words ‘‘Liberty’’,
13
‘‘In God We Trust’’, ‘‘United States of Amer-
14
ica’’, and ‘‘E Pluribus Unum’’.
15
(b) SELECTION.—The design for the coins minted
16
under this Act shall be—
17
(1) selected by the Secretary after consultation
18
with the Commission of Fine Arts and the National
19
Purple Heart Hall of Honor, Inc.; and
20
(2) reviewed by the Citizens Coinage Advisory
21
Committee.

SEC. 5. ISSUANCE OF COINS.
23
(a) QUALITY OF COINS.—Coins minted under this
24
Act shall be issued in uncirculated and proof qualities.

(b) MINT FACILITY.—Only the West Point Mint may
1
be used to strike any particular quality of the coins minted
2
under this Act.
3
(c) PERIOD
FOR ISSUANCE.—The Secretary may
4
issue coins minted under this Act only during the 1-year
5
period beginning on January 1, 2021.

SEC. 6. SALE OF COINS.
7
(a) SALE PRICE.—The coins issued under this Act
8
shall be sold by the Secretary at a price equal to the sum
9
of—
10
(1) the face value of the coins;
11
(2) the surcharge provided in section 7(a) with
12
respect to such coins; and
13
(3) the cost of designing and issuing the coins
14
(including labor, materials, dies, use of machinery,
15
overhead expenses, marketing, and shipping).
16
(b) BULK SALES.—The Secretary shall make bulk
17
sales of the coins issued under this Act at a reasonable
18
discount.
19
(c) PREPAID ORDERS.—
20
(1) IN GENERAL.—The Secretary shall accept
21
prepaid orders for the coins minted under this Act
22
before the issuance of such coins.

(2) DISCOUNT.—Sale prices with respect to pre-
1
paid orders under paragraph (1) shall be at a rea-
2
sonable discount.

SEC. 7. SURCHARGES.
4
(a) IN GENERAL.—All sales of coins issued under this
5
Act shall include a surcharge of—
6
(1) $35 per coin for the $5 coin;
7
(2) $10 per coin for the $1 coin; and
8
(3) $5 per coin for the half-dollar coin.
9
(b) DISTRIBUTION.—Subject to section 5134(f)(1) of
10
title 31, United States Code, all surcharges received by
11
the Secretary from the sale of coins issued under this Act
12
shall be promptly paid by the Secretary to the National
13
Purple Heart Hall of Honor, Inc. to support the mission
14
of the National Purple Heart Hall of Honor, Inc., includ-
15
ing capital improvements to the National Purple Heart
16
Hall of Honor facilities.
17
(c) AUDITS.—The National Purple Heart Hall of
18
Honor, Inc. shall be subject to the audit requirements of
19
section 5134(f)(2) of title 31, United States Code, with
20
regard to the amounts received under subsection (b).
21
(d) LIMITATION.—Notwithstanding subsection (a),
22
no surcharge may be included with respect to the issuance
23
under this Act of any coin during a calendar year if, as
24
of the time of such issuance, the issuance of such coin

would result in the number of commemorative coin pro-

grams issued during such year to exceed the annual 2
2
commemorative coin program issuance limitation under
3
section 5112(m)(1) of title 31, United States Code (as in
4
effect on the date of the enactment of this Act). The Sec-
5
retary of the Treasury may issue guidance to carry out
6
this subsection.
