A BILL
To amend the Fair Labor Standards Act of 1938 to prohibit
States and municipalities from adopting certain laws and
ordinances, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Wage Increase Fair-
4
ness Act’’.

SEC. 2. AMENDMENT TO THE FAIR LABOR STANDARDS ACT

Section 6 of the Fair Labor Standards Act (29
3
U.S.C. 206) is amended by adding at the end the fol-
4
lowing:
5
‘‘(h) Nothing in this subsection shall limit the amount
6
of a minimum wage set pursuant to this section, or of a
7
minimum wage set by a State or municipality pursuant
8
to section 18 of this Act, provided that: notwithstanding
9
section 18 or any other provision of law, no State or mu-
10
nicipality shall adopt any law or ordinance which has the
11
purpose or effect of establishing a minimum wage which
12
distinguishes, classifies, or establishes any requirement on
13
an employer based on its status as excluded from the defi-
14
nition of ‘‘enterprise’’ pursuant to the second sentence of
15
section 3(r)(1).’’.
