Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Earl N. Williams, Sr., 4 First Chance Act’’. 5 SEC. 2. 3 (B) in paragraph (6), by striking the pe- 4 riod at the end and inserting ‘‘; and’’; and 5 (C) by adding at the end the following: 6 ‘‘(7) basic and emergency supplemental living 7 assistance grants in accordance with subsection 8 (f).’’; and 9 (2) by adding at the end the following: 10 ‘‘(f) BASIC AND EMERGENCY SUPPLEMENTAL LIV- 11 ING ASSISTANCE GRANTS.— 12 ‘‘(1) IN GENERAL.—In carrying out the activi- 13 ties required under subsection (b)(7) with a grant 14 received under this section, the recipient of such 15 grant shall provide basic and emergency supple- 16 mental living assistance grants to assist students 17 who are current participants in the student support 18 services program offered by the institution (in this 19 subsection referred to as ‘eligible students’)— 20 ‘‘(A) in the case of a basic supplemental 21 living assistance grant, in covering reasonable, 22 anticipated expenses necessary for the comple- 23 tion of an academic year of the students’ first 24 VerDate Sep 11 2014 03:01 Jul 02, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3470.IH H3470 kjohnson on DSK79L0C42 with BILLS 3 •HR 3470 IH undergraduate baccalaureate course of study; 1 and 2 ‘‘(B) in the case of an emergency supple- 3 mental living assistance grant, in covering rea- 4 sonable, unanticipated expenses necessary for 5 the students to persist in college during such 6 academic year. 7 ‘‘(2) AMOUNT OF GRANTS.—The recipient may 8 determine— 9 ‘‘(A) the appropriate division of the funds 10 between basic and emergency supplemental as- 11 sistance grants, except that funds shall be pro- 12 vided for both basic and emergency grants; 13 ‘‘(B) the amount of each such grant and 14 the total grant funds that an eligible student 15 may receive, except that a student may not re- 16 ceive more than a total of $500 in emergency 17 supplemental assistance grants per academic 18 year; and 2 ‘‘(ii) for an individual student, may 3 cover— 4 ‘‘(I) any component of the cost of 5 attendance for the student; 6 ‘‘(II) an allowance for actual or 7 expected expenses incurred for de- 8 pendent care that exceeds such ex- 9 penses determined for the student 10 under section 472(8); 11 ‘‘(III) an allowance for actual or 12 expected expenses for transportation 13 that exceeds such expenses deter- 14 mined for the student under section 15 472; and 16 ‘‘(IV) personal items or expenses 17 not otherwise covered by the cost of 18 attendance for the student. 19 ‘‘(3) PERCENTAGE OF TOTAL FUNDS.—The re- 20 cipient may use not more than 2 percent of the 21 funds awarded under this section for grants under 22 this subsection. 23 ‘‘(4) DETERMINATION OF NEED.—A grant pro- 24 vided to a student under this subsection shall not be 25 VerDate Sep 11 2014 03:01 Jul 02, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3470.IH H3470 kjohnson on DSK79L0C42 with BILLS 5 •HR 3470 IH considered in determining that student’s need for 1 grant or work assistance under this title, except that 2 in no case shall the total amount of student financial 3 assistance awarded to a student under this title ex- 4 ceed that student’s cost of attendance by more than 5 $500. 6 ‘‘(5) CONSULTATION.—In making grants to 7 students under this subsection, an institution shall 8 ensure that adequate consultation takes place be- 9 tween the student support service program office 10 and the institution’s financial aid office. 11 ‘‘(6) SUPPLEMENT, NOT SUPPLANT.—Funds re- 12 ceived by a grant recipient that are used under this 13 subsection shall be used to supplement, and not sup- 14 plant, non-Federal funds expended for student sup- 15 port services programs. 16 ‘‘(7) FUNDS.—For a fiscal year for which the 17 funds allocated for projects authorized under this 18 section from the amounts appropriated pursuant to 19 the authority of section 402A(g) exceeds the funds 20 allocated for such purpose for fiscal year 2019, not 21 more than 2 percent of such excess funds may be 22 made available for grants under this subsection. 23 VerDate Sep 11 2014 03:01 Jul 02, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H3470.IH H3470 kjohnson on DSK79L0C42 with BILLS 6 •HR 3470 IH ‘‘(8) DEFINITION.—In this subsection, the term 1 ‘cost of attendance’ has the meaning given the term 2 in section 472.’’. 3 Æ VerDate Sep 11 2014 03:01 Jul 02, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\H3470.IH H3470 kjohnson on DSK79L0C42 with BILLS
