Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PUBLIC PARTICIPATION. 1 (a) PROPOSED PLAN.—Section 117(a) of the Com- 2 prehensive Environmental Response, Compensation, and 3 Liability Act of 1980 (42 U.S.C. 9617(a)) is amended— 4 (1) in the matter preceding paragraph (1), by 5 striking ‘‘both of’’; 6 (2) by redesignating paragraph (2) as para- 7 graph (3); 8 (3) by inserting after paragraph (1) the fol- 9 lowing: 10 ‘‘(2) Transmit the notice and analysis published 11 under paragraph (1) to officials for the local govern- 12 ment with jurisdiction over the facility at issue, in- 13 cluding— 14 ‘‘(A) any applicable mayor or city council; 15 and 16 ‘‘(B) if no mayor or city council is avail- 17 able, the highest ranking official of such local 18 government, as applicable.’’; and 19 (4) in paragraph (3) (as redesignated by para- 20 graph (2) of this subsection) by inserting ‘‘(includ- 21 ing comments regarding use of the facility at issue 22 after remedial action is taken)’’ after ‘‘written and 23 oral comments’’. 24 (b) FINAL PLAN.—Section 117(b) of the Comprehen- 25 sive Environmental Response, Compensation, and Liabil- 26 VerDate Sep 11 2014 04:15 Jun 26, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3382.IH H3382 kjohnson on DSK79L0C42 with BILLS 3 •HR 3382 IH ity Act of 1980 (42 U.S.C. 9617(b)) is amended by insert- 1 ing ‘‘, and transmitted to officials described in subsection 2 (a)(2),’’ after ‘‘available to the public’’. 3 (c) PUBLICATION.—Section 117(d) of the Com- 4 prehensive Environmental Response, Compensation, and 5 Liability Act of 1980 (42 U.S.C. 9617(d)) is amended— 6 (1) by inserting ‘‘and require’’ after ‘‘publica- 7 tion shall include’’; and 8 (2) by striking ‘‘general circulation.’’ and in- 9 serting ‘‘general circulation (if available), announce- 10 ment sent to a radio station, or television station, 11 the broadcast area of which includes the community 12 surrounding the facility at issue, and posting to the 13 website of the Environmental Protection Agency.’’. 14 Æ VerDate Sep 11 2014 04:15 Jun 26, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3382.IH H3382 kjohnson on DSK79L0C42 with BILLS
