Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Aamodt Litigation Set- 4 tlement Completion Act of 2019’’. 5 SEC. 2. AMENDMENTS TO AAMODT LITIGATION SETTLE- 6 MENT ACT. 7 (a) DEFINITION OF 611(g) AGREEMENT.—Section 8 602 of the Aamodt Litigation Settlement Act (Public Law 9 111–291; 124 Stat. 3134) is amended— 10 VerDate Sep 11 2014 02:13 Jun 19, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1875.IS S1875 kjohnson on DSK79L0C42 with BILLS 2 •S 1875 IS (1) by redesignating paragraphs (1) through 1 (23) as paragraphs (2) through (24), respectively; 2 and 3 (2) by inserting before paragraph (2) (as so re- 4 designated) the following: 5 ‘‘(1) 611(g) AGREEMENT.—The term ‘611(g) 6 Agreement’ means the agreement to be executed by 7 the United States, the State, the Pueblos, the Coun- 8 ty, and the City pursuant to section 611(g).’’. 9 (b) CONSTRUCTION COSTS FOR PUEBLO WATER FA- 10 CILITIES.—Section 611(f) of the Aamodt Litigation Set- 11 tlement Act (Public Law 111–291; 124 Stat. 3138) is 12 amended— 13 (1) in paragraph (1)— 14 (A) in subparagraph (A), by striking 15 ‘‘$106,400,000’’ and inserting ‘‘$256,400,000’’; 16 and 17 (B) by striking subparagraph (B) and in- 18 serting the following: 19 ‘‘(B) EXCEPTION.—Of the amount de- 20 scribed in subparagraph (A)— 21 ‘‘(i) the initial $106,400,000 shall be 22 increased or decreased, as appropriate, 23 based on ordinary fluctuations in construc- 24 tion costs since October 1, 2006, as deter- 25 VerDate Sep 11 2014 02:13 Jun 19, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1875.IS S1875 kjohnson on DSK79L0C42 with BILLS 3 •S 1875 IS mined using applicable engineering cost in- 1 dices; and 2 ‘‘(ii) any amounts made available in 3 excess of the amount described in clause 4 (i) shall be increased or decreased, as ap- 5 propriate, based on ordinary fluctuations 6 in construction costs since October 1, 7 2018, as determined using applicable engi- 8 neering cost indices.’’; and 9 (2) in paragraph (3), by inserting ‘‘and the 10 611(g) Agreement’’ after ‘‘the Cost-Sharing and 11 System Integration Agreement’’. 12 (c) FUNDING FOR REGIONAL WATER SYSTEM.—Sec- 13 tion 617(a)(1)(B) of the Aamodt Litigation Settlement 14 Act (Public Law 111–291; 124 Stat. 3147) is amended— 15 (1) by striking ‘‘$50,000,000’’ and inserting 16 ‘‘$200,000,000’’; and 17 (2) by striking ‘‘2024’’ and inserting ‘‘2028’’. 18 (d) EXECUTION OF AGREEMENT UNDER SECTION 19 611(g).—Section 621 of the Aamodt Litigation Settle- 20 ment Act (Public Law 111–291; 124 Stat. 3149) is 21 amended by striking subsections (a) and (b) and inserting 22 the following: 23 ‘‘(a) APPROVAL.—To the extent the Settlement 24 Agreement, the Cost-Sharing and System Integration 25 VerDate Sep 11 2014 02:13 Jun 19, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1875.IS S1875 kjohnson on DSK79L0C42 with BILLS 4 •S 1875 IS Agreement, and the 611(g) Agreement do not conflict with 1 this title, the Settlement Agreement, the Cost-Sharing and 2 System Integration Agreement, and the 611(g) Agreement 3 (including any amendments to the Settlement Agreement, 4 the Cost-Sharing and System Integration Agreement, and 5 the 611(g) Agreement that are executed to make the Set- 6 tlement Agreement, the Cost-Sharing and System Integra- 7 tion Agreement, or the 611(g) Agreement consistent with 8 this title) are authorized, ratified, and confirmed. 9 ‘‘(b) EXECUTION.—To the extent the Settlement 10 Agreement, the Cost-Sharing and System Integration 11 Agreement, and the 611(g) Agreement do not conflict with 12 this title, the Secretary shall execute the Settlement 13 Agreement, the Cost-Sharing and System Integration 14 Agreement, and the 611(g) Agreement (including any 15 amendments that are necessary to make the Settlement 16 Agreement, the Cost-Sharing and System Integration 17 Agreement, or the 611(g) Agreement consistent with this 18 title).’’. 19 (e) FINAL DECREE.—Section 623(e) of the Aamodt 20 Litigation Settlement Act (Public Law 111–291; 124 Stat. 21 3152) is amended— 22 (1) in paragraph (2), by striking ‘‘2024’’ and 23 inserting ‘‘2028’’; and 24 VerDate Sep 11 2014 02:13 Jun 19, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1875.IS S1875 kjohnson on DSK79L0C42 with BILLS 5 •S 1875 IS (2) in paragraph (5)(A), by striking ‘‘2024’’ 1 and inserting ‘‘2028’’. 2 Æ VerDate Sep 11 2014 02:13 Jun 19, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S1875.IS S1875 kjohnson on DSK79L0C42 with BILLS
