SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘LGBTQ Essential
2
Data Act’’.

SEC. 2. IMPROVING DATA COLLECTION ON THE SEXUAL
4
ORIENTATION AND GENDER IDENTITY OF DE-
5
CEASED INDIVIDUALS THROUGH THE NA-
6
TIONAL VIOLENT DEATH REPORTING SYS-
7
TEM.

(a) COLLECTION
OF SEXUAL ORIENTATION
AND
9
GENDER IDENTITY DATA.—
10
(1) IN
GENERAL.—Not later than 120 days
11
after the date of enactment of this Act, the Director
12
of the Centers for Disease Control and Prevention
13
shall take measures to improve the incidence of the
14
collection of information on the sexual orientation
15
and gender identity of deceased individuals through
16
the National Violent Death Reporting System or any
17
successor programs.
18
(2) CONFIDENTIALITY.—Any information col-
19
lected relating to the sexual orientation or gender
20
identity of a decedent shall be maintained in accord-
21
ance with the confidentiality and privacy standards
22
and policies for the protection of individuals applica-
23
ble to all other data collected for purposes of the
24
National Violent Death Reporting System.

(b) DEFINITIONS.—In this section:

(1) GENDER
IDENTITY.—The term ‘‘gender
1
identity’’ means an individual’s sense of being male,
2
female, transgender, or another gender, as distinct
3
from the individual’s sex assigned at birth.
4
(2) SEXUAL ORIENTATION.—The term ‘‘sexual
5
orientation’’ means how a person identifies in terms
6
of their emotional, romantic, or sexual attractions,
7
and includes identification as straight, heterosexual,
8
gay, lesbian, or bisexual, among other terms.
9
(c) AUTHORIZATION.—There is authorized to be ap-
10
propriated $25,000,000 for fiscal year 2020 to carry out
11
this section.

SEC. 3. SENSE OF CONGRESS.
13
It is the sense of the Congress that—
14
(1) the Centers for Disease Control and Preven-
15
tion has made significant efforts to encourage States
16
and other jurisdictions to collect data on sexual ori-
17
entation and gender identity through the National
18
Violent Death Reporting System; and
19
(2) jurisdictions that participate in the collec-
20
tion of such data through the National Violent
21
Death Reporting System should be commended for
22
their participation.
