the construction of Russian energy export pipelines, and for other purposes.

Mr. KINZINGER (for himself, Mr. PENCE, and Mr. HECK) introduced the fol-
lowing bill; which was referred to the Committee on Foreign Affairs, and
in addition to the Committee on the Judiciary, for a period to be subse-
quently determined by the Speaker, in each case for consideration of such
provisions as fall within the jurisdiction of the committee concerned
A BILL
To impose sanctions with respect to the provision of certain
vessels for the construction of Russian energy export
pipelines, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Protecting Europe’s
4
Energy Security Act of 2019’’.
5
SEC. 2. SENSE OF CONGRESS ON RUSSIAN ENERGY
6
PROJECTS.
7
It is the sense of Congress that—

(1) the Government of the Russian Federation,
1
working through Russian state-owned enterprises,
2
uses energy as a tool of coercion and political lever-
3
age;
4
(2) the Government of Russia pursues a strat-
5
egy to make European countries dependent on Rus-
6
sia for energy supplies, so as to increase this polit-
7
ical leverage;
8
(3) a central aspect to this Russian strategy is
9
the development of export energy pipelines that are
10
driven not by commercial viability but by the foreign
11
policy goals of Russia;
12
(4) the Nord Stream 2 pipeline and the Turk
13
Stream pipeline are two examples of such Russian
14
energy export pipelines;
15
(5) the President should take action to halt
16
such Russian energy export pipelines unless the
17
President determines that doing so is not in the na-
18
tional interest of the United States; and
19
(6) in making such a determination, the Presi-
20
dent should consider whether—
21
(A) the non-Russian parties involved in the
22
project have put in place safeguards to mini-
23
mize the ability of Russia to use the pipeline as
24
a tool of coercion and political leverage, includ-

ing by requiring unbundling of energy produc-
1
tion and transmission, transparency in the en-
2
ergy market, and effective regulatory oversight;
3
and
4
(B) the non-Russian parties involved in the
5
project have taken concrete steps to ensure that
6
it will not result in a significant decrease in the
7
transit of Russian energy exports through exist-
8
ing pipelines in other countries, particularly
9
Ukraine.

SEC. 3. SANCTIONS WITH RESPECT TO THE PROVISION OF
11
PIPE-LAYING VESSELS FOR THE CONSTRUC-
12
TION OF RUSSIAN ENERGY EXPORT PIPE-
13
LINES.

(a) IN GENERAL.—The President shall impose the
15
sanctions described in subsection (b) on each foreign per-
16
son that the President determines knowingly, on or after
17
the date of the enactment of this Act, sells, leases, or pro-
18
vides pipe-laying vessels for the construction of any Rus-
19
sian-origin energy export pipeline that makes landfall in
20
Germany or Turkey.
21
(b) SANCTIONS DESCRIBED.—
22
(1) IN GENERAL.—The sanctions described in
23
this subsection are the following:

(A) ASSET BLOCKING.—The blocking, in
1
accordance with the International Emergency
2
Economic Powers Act (50 U.S.C. 1701 et seq.),
3
of all transactions in all property and interests
4
in property of a foreign person if such property
5
and interests in property are in the United
6
States, come within the United States, or are or
7
come within the possession or control of a
8
United States person.
9
(B) INADMISSIBILITY
TO
THE
UNITED
10
STATES.—In the case of a foreign person who
11
is an individual—
12
(i) ineligibility to receive a visa to
13
enter the United States or to be admitted
14
to the United States; or
15
(ii) if the individual has been issued a
16
visa or other documentation, revocation, in
17
accordance with section 221(i) of the Im-
18
migration and Nationality Act (8 U.S.C.
19
1201(i)), of the visa or other documenta-
20
tion.
21
(2) PENALTIES.—A person that violates, at-
22
tempts to violate, conspires to violate, or causes a
23
violation of a measure imposed pursuant to sub-
24
section (a) or any regulation, license, or order issued

to carry out this section shall be subject to the pen-
1
alties specified in subsections (b) and (c) of section
2
206 of the International Emergency Economic Pow-
3
ers Act (50 U.S.C. 1705) to the same extent as a
4
person that commits an unlawful act described in
5
subsection (a) of such section.

(3) EXCEPTION RELATING TO IMPORTATION OF
7
GOODS.—
8
(A) IN
GENERAL.—The requirement to
9
block and prohibit all transactions in all prop-
10
erty and interests in property under subsection
11
(b)(1)(A) does not include the authority to im-
12
pose sanctions on the importation of goods.
13
(B) GOOD
DEFINED.—The term ‘‘good’’
14
means any article, natural or man-made sub-
15
stance, material, supply or manufactured prod-
16
uct, including inspection and test equipment,
17
and excluding technical data.
18
(4) EXCEPTION TO COMPLY WITH UNITED NA-
19
TIONS
HEADQUARTERS
AGREEMENT.—Sanctions
20
under paragraph (1)(B) shall not apply with respect
21
to the admission of an alien to the United States if
22
the admission of the alien is necessary to permit the
23
United States to comply with the Agreement regard-
24
ing the Headquarters of the United Nations, signed

at Lake Success June 26, 1947, and entered into
1
force November 21, 1947, between the United Na-
2
tions and the United States, or other applicable
3
international obligations.
4
(c) IMPLEMENTATION; REGULATORY AUTHORITY.—
5
(1) IMPLEMENTATION.—The President may ex-
6
ercise all authorities provided under sections 203
7
and 205 of the International Emergency Economic
8
Powers Act (50 U.S.C. 1702 and 1704) to carry out
9
this section.
10
(2) REGULATORY AUTHORITY.—The President
11
shall issue such regulations, licenses, and orders as
12
are necessary to carry out this section.
13
(d) NATIONAL INTEREST WAIVER.—The President
14
may waive the application of the sanctions under sub-
15
section (b) with respect to a foreign person if the Presi-
16
dent—
17
(1) determines that such a waiver is in the na-
18
tional interest of the United States; and
19
(2) submits to the appropriate congressional
20
committees a notice of and justification for the waiv-
21
er.
22
(e) TERMINATION AND SUNSET.—The authority to
23
impose sanctions with regards to a person involved in the
24
construction of a particular Russian energy export pipeline

under subsection (b), and any sanctions imposed pursuant
1
to such authority, shall terminate on the earlier of—
2
(1) the date on which the President certifies to
3
the appropriate congressional committees that ap-
4
propriate safeguards have been put in place to—
5
(A) minimize the ability of Russia to use
6
the pipeline as a tool of coercion and political
7
leverage, including by achieving unbundling of
8
energy production and transmission so that
9
Russian state-owned entities do not control the
10
transmission network for the pipelines, trans-
11
parency in the energy market, and effective reg-
12
ulatory oversight; and
13
(B)
ensure,
barring
unforeseen
cir-
14
cumstances, that the project would not result in
15
a decrease of more than 25 percent in the tran-
16
sit of Russian energy exports through existing
17
pipelines
in
other
countries,
particularly
18
Ukraine, relative to the average monthly transit
19
of Russian energy exports through such pipe-
20
lines in 2018; or
21
(2) the date that is 10 years after the date of
22
the enactment of this Act.

(f) DEFINITIONS.—In this section:

(1) ADMISSION; ADMITTED; ALIEN.—The terms
1
‘‘admission’’, ‘‘admitted’’, and ‘‘alien’’ have the
2
meanings given those terms in section 101 of the
3
Immigration and Nationality Act (8 U.S.C. 1101).
4
(2) APPROPRIATE
CONGRESSIONAL
COMMIT-
5
TEES.—The term ‘‘appropriate congressional com-
6
mittees’’ means—
7
(A) the Committee on Foreign Affairs, the
8
Committee on the Judiciary, and the Com-
9
mittee on Financial Services of the House of
10
Representatives; and
11
(B) the Committee on Foreign Relations,
12
the Committee on the Judiciary, and the Com-
13
mittee on Banking, Housing, and Urban Affairs
14
of the Senate.
15
(3) FOREIGN PERSON.—The term ‘‘foreign per-
16
son’’ means an individual or entity that is not a
17
United States person.
18
(4) KNOWINGLY.—The term ‘‘knowingly’’ with
19
respect to conduct, a circumstance, or a result,
20
means that a person has actual knowledge, or should
21
have known, of the conduct, the circumstance, or the
22
result.
23
(5) PIPE-LAYING VESSEL.—The term ‘‘pipe-lay-
24
ing vessel’’ means an offshore vessel that can be

used in the construction of subsea infrastructure
1
and is engaged in pipe-laying at depths of 100 feet
2
or more below sea level.

UNITED
STATES
PERSON.—The
term
4
‘‘United States person’’ means—
5
(A) a United States citizen or an alien law-
6
fully admitted for permanent residence to the
7
United States; or
8
(B) an entity organized under the laws of
9
the United States or any jurisdiction within the
10
United States, including a foreign branch of
11
such an entity.
