Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. COVER CROPS PLANTED DUE TO PREVENTED 1 PLANTING. 2 Section 508A(c) of the Agricultural Adjustment Act 3 of 1938 (7 U.S.C. 1508a(c)) is amended— 4 (1) by amending subparagraph (B) of para- 5 graph (1) to read as follows: 6 ‘‘(B) SECOND CROP PLANTED.—The pro- 7 ducer may plant a second crop on the same 8 acreage for harvest in the same crop year and 9 collect one of the following: 10 ‘‘(i) Subject to paragraphs (4) and 11 (5), an indemnity payment established by 12 the Corporation for the first crop, but not 13 to exceed 35 percent of the prevented 14 planting guarantee for the acreage for the 15 first crop. 16 ‘‘(ii) An indemnity that is equal to 17 100 percent of the prevented planting 18 guarantee for the acreage for the first 19 crop, if each of the following conditions are 20 met: 21 ‘‘(I) The Secretary determines 22 that the acres planted are in an area 23 with low hay or forage supplies due to 24 widespread excessive moisture, flood, 25 drought, or other factors. 26 VerDate Sep 11 2014 05:05 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3183.IH H3183 jbell on DSK3GLQ082PROD with BILLS 3 •HR 3183 IH ‘‘(II) The second crop will be 1 planted with an intended use of ani- 2 mal feed that is hayed, grazed, or 3 chopped. 4 ‘‘(III) The second crop will be 5 donated or used by the producer.’’; 6 and 7 (2) in paragraph (3)— 8 (A) by inserting ‘‘a second crop planted as 9 described in paragraph (1)(B)(ii) or’’ before 10 ‘‘double cropping’’; and 11 (B) by striking ‘‘make an election under 12 paragraph (1)(B)’’ and inserting ‘‘makes an 13 election under paragraph (1)(B)(i)’’. 14 Æ VerDate Sep 11 2014 05:05 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3183.IH H3183 jbell on DSK3GLQ082PROD with BILLS
