Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Fix Funding First 4 Act’’. 5 SEC. 2. CHANGE OF FISCAL YEAR. 6 (a) IN GENERAL.— 7 (1) CHANGE OF CALENDAR PERIOD.—Section 8 1102 of title 31, United States Code, is amended— 9 (A) by striking ‘‘October 1’’ and inserting 10 ‘‘January 1’’; and 11 VerDate Sep 11 2014 22:26 Jun 17, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1807.IS S1807 pamtmann on DSKBFK8HB2PROD with BILLS 2 •S 1807 IS (B) by striking ‘‘September 30 of the fol- 1 lowing year’’ and inserting ‘‘December 31 of 2 that year’’. 3 (2) EFFECTIVE DATE.—The amendments made 4 by paragraph (1) shall take effect on January 1, 5 2021. 6 (b) TRANSITION TO NEW FISCAL YEAR.— 7 (1) TRANSITION PERIOD BUDGET.—As soon as 8 practicable, the President shall prepare and submit 9 to Congress— 10 (A) after consultation with the Committee 11 on the Budget and the Committee on Appro- 12 priations of the House of Representatives and 13 the Committee on the Budget and the Com- 14 mittee on Appropriations of the Senate, budget 15 estimates for the Federal Government for the 16 period commencing October 1, 2020, and end- 17 ing on December 31, 2020, in such form and 18 detail as the President may determine; and 19 (B) proposed legislation the President con- 20 siders appropriate with respect to changes in 21 law necessary to provide authorizations of ap- 22 propriations for that period. 23 (2) AGENCY TRANSITION.—The Director of the 24 Office of Management and Budget shall— 25 VerDate Sep 11 2014 22:26 Jun 17, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1807.IS S1807 pamtmann on DSKBFK8HB2PROD with BILLS 3 •S 1807 IS (A) provide by regulation, order, or other- 1 wise for the orderly transition by all depart- 2 ments, agencies, and instrumentalities of the 3 Federal Government and the government of the 4 District of Columbia from the use of the fiscal 5 year in effect on the date of the enactment of 6 this Act to the use of the new fiscal year pre- 7 scribed under the amendments made by sub- 8 section (a); and 9 (B) prepare and submit to Congress such 10 additional proposed legislation as the Director 11 considers necessary to accomplish the orderly 12 transition to such new fiscal year. 13 (c) CONVERSION OF AUTHORIZATIONS OF APPRO- 14 PRIATIONS.—Any law providing for an authorization of 15 appropriations commencing on October 1 of a year shall, 16 if that year is any year after 2019, be considered as mean- 17 ing January 1 of the following year. Any law providing 18 for an authorization of appropriations ending on Sep- 19 tember 30 of a year shall, if that year is any year after 20 2019, be considered as meaning December 31 of that year. 21 Any law providing for an authorization of appropriations 22 for the fiscal year 2021 or any fiscal year thereafter shall 23 be construed as referring to that fiscal year ending on De- 24 VerDate Sep 11 2014 22:26 Jun 17, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1807.IS S1807 pamtmann on DSKBFK8HB2PROD with BILLS 4 •S 1807 IS cember 31 of the calendar year having the same calendar 1 year number as the fiscal year number. 2 (d) TITLE OF APPROPRIATION ACTS.— 3 (1) IN GENERAL.—Section 105 of title 1, 4 United States Code, is amended by striking ‘‘Sep- 5 tember 30’’ and inserting ‘‘December 31’’. 6 (2) EFFECTIVE DATE.—The amendment made 7 by paragraph (1) shall apply with respect to any fis- 8 cal year commencing on or after January 1, 2021. 9 (e) CONFORMING AMENDMENTS.—Section 202(e) of 10 the Congressional Budget and Impoundment Control Act 11 of 1974 (2 U.S.C. 602(e)) is amended— 12 (1) in paragraph (1)— 13 (A) in the first sentence— 14 (i) by striking ‘‘On or before February 15 15 of each year, the Director shall’’ and 16 inserting ‘‘During an even-numbered year, 17 the Director may’’; and 18 (ii) by striking ‘‘October 1 of that 19 year’’ and inserting ‘‘January 1 of the next 20 calendar year’’; and 21 (B) in the second sentence, by striking 22 ‘‘shall also include’’ and inserting ‘‘may in- 23 clude’’; and 24 (2) in paragraph (3)— 25 VerDate Sep 11 2014 22:26 Jun 17, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1807.IS S1807 pamtmann on DSKBFK8HB2PROD with BILLS 5 •S 1807 IS (A) by striking ‘‘On or before January 15 1 of each year, the Director’’ and inserting ‘‘The 2 Director’’; 3 (B) by striking ‘‘September 30’’ each place 4 it appears and inserting ‘‘December 31’’; and 5 (C) by striking ‘‘October 1 of that calendar 6 year’’ and inserting ‘‘January 1 of the next cal- 7 endar year’’. 8 SEC. 3. LEGALLY BINDING BIENNIAL BUDGET. 9 (a) PURPOSES.—Section 2(2) of the Congressional 10 Budget and Impoundment Control Act of 1974 (2 U.S.C. 11 621(2)) is amended to read as follows: 12 ‘‘(2) to facilitate the determination biennially of 13 the appropriate level of Federal revenues and ex- 14 penditures by the Congress;’’. 15 (b) DEFINITIONS.—Section 3 of the Congressional 16 Budget and Impoundment Control Act of 1974 (2 U.S.C. 17 622) is amended— 18 (1) by striking paragraph (4) and inserting the 19 following: 20 ‘‘(4) The term ‘joint resolution on the budget’ 21 means— 22 ‘‘(A) a joint resolution setting forth the 23 budget for the United States Government for a 24 biennium as provided in section 301; and 25 VerDate Sep 11 2014 22:26 Jun 17, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S1807.IS S1807 pamtmann on DSKBFK8HB2PROD with BILLS 6 •S 1807 IS ‘‘(B) any other joint resolution revising the 1 budget for the United States Government for a 2 biennium as described in section 304.’’; and 3 (2) by adding at the end the following: 4 ‘‘(12) The term ‘biennium’ means any period of 5 2 consecutive fiscal years beginning with an even- 6 numbered fiscal year. 7 ‘‘(13) The term ‘budget year’ has the meaning 8 given that term in section 250(c)(12) of the Bal- 9 anced Budget and Emergency Control Act of 10 1985.’’. 11 (c) REVISION OF TIMETABLE.—Section 300 of the 12 Congressional Budget Act of 1974 (2 U.S.C. 631) is 13 amended to read as follows: 14 ‘‘SEC. 300. TIMETABLE. 15 ‘‘The timetable with respect to the congressional 16 budget process is as follows: 17 ‘‘On or before: Action to be completed: November 15 of each year (ex- cluding a year during which a Presidential election is held, unless the individual serving as President is elected to suc- ceed himself or herself as President). President submits to Congress the budget of the President. Friday before the third Monday in February of each odd-num- bered year. Joint resolution on the budget for the next biennium enacted. Friday before the first Saturday after the first full moon oc- curring on or after the vernal equinox of each year. Senate and the House of Representatives have passed regular appropriations bills that appropriate not less than 25 percent of the total level of discretionary spending for the next fiscal year. Senate and the House of Representatives have passed regular appropriations bills that appropriate not less than 50 percent of the total level of discretionary spending for the next fiscal year. Friday before July 4 of each year. Senate and the House of Representatives have passed regular appropriations bills that appropriate not less than 75 percent of the total level of discretionary spending for the next fiscal year. July 31 of each year .................. Senate and the House of Representatives have passed all the regular appropriations bills for the next fiscal year. September 30 of each year ........ All regular appropriation bills for the next fiscal year have been enacted. September 30 of each even-num- bered year. The Committee on the Budget of the Senate and the Committee on the Budget of the House of Representatives have reported the concurrent resolution setting forth a long-term budget projection required under section 308(e).’’. (d) BIENNIAL JOINT RESOLUTIONS ON THE BUDG- 1 ET.— 2 (1) CONTENTS OF RESOLUTION.— 3 (A) IN GENERAL.—Section 301(a) of the 4 Congressional Budget Act of 1974 (2 U.S.C. 5 632(a)) is amended— 6 (i) in the subsection heading by strik- 7 ing ‘‘CONCURRENT’’ and inserting 8 ‘‘JOINT’’; and 9 (ii) by striking ‘‘On or before April 10 15’’ and all that follows through the end of 11 the matter following paragraph (7) and in- 12 serting ‘‘On or before the Friday before 13 the third Monday in February of each odd- 14 numbered calendar year, a joint resolution 15 VerDate Sep 11 2014 22:26 Jun 17, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\S1807.IS S1807 pamtmann on DSKBFK8HB2PROD with BILLS 8 •S 1807 IS on the budget for the biennium beginning 1 on January 1 of the next calendar year 2 shall be enacted. The joint resolution shall 3 include an allocation of the levels for each 4 fiscal year in the biennium of total new 5 budget authority and total outlays for each 6 committee of the House of Representatives 7 or the Senate that has jurisdiction over 8 legislation providing or creating such 9 amounts.’’. 10 (B) ADDITIONAL MATTERS IN RESOLU- 11 TION.—Section 301(b) of the Congressional 12 Budget Act of 1974 (2 U.S.C. 632(b)) is 13 amended— 14 (i) in the subsection heading by strik- 15 ing ‘‘CONCURRENT’’ and inserting 16 ‘‘JOINT’’; 17 (ii) by striking ‘‘concurrent’’ each 18 place it appears and inserting ‘‘joint’’; 19 (iii) in paragraph (3), by striking ‘‘for 20 such fiscal year’’ and inserting ‘‘for either 21 fiscal year in such biennium’’; 17 ‘‘(C) the surplus or deficit in the budget; 18 ‘‘(D) new budget authority and outlays for 19 each major functional category, based on alloca- 20 tions of the total levels set forth pursuant to 21 subparagraph (A); 2 and 3 ‘‘(G) for purposes of Senate enforcement 4 under this title, revenues of the old-age, sur- 5 vivors, and disability insurance program estab- 6 lished under title II of the Social Security Act 7 (and the related provisions of the Internal Rev- 8 enue Code of 1986).’’. 9 (2) CONSIDERATION OF CERTAIN MATTERS IN 10 THE HOUSE OF REPRESENTATIVES.—Section 301(c) 11 of the Congressional Budget Act of 1974 (2 U.S.C. 12 632(c)) is amended by striking ‘‘concurrent’’ each 13 place it appears and inserting ‘‘joint’’. 14 (3) COMMITTEE VIEWS AND ESTIMATES.—Sec- 15 tion 301 of the Congressional Budget Act of 1974 16 (2 U.S.C. 632) is amended by striking subsection 17 (d). 18 (4) HEARINGS AND REPORT.—Section 301(e) of 19 the Congressional Budget Act of 1974 (2 U.S.C. 20 632(e)) is amended— 21 (A) by striking ‘‘concurrent’’ each place it 22 appears and inserting ‘‘joint’’;
