Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. REPEAL OF FEDERAL HIGHWAY ADMINISTRATION 1 REGULATION. 2 Section 668.105(h) of title 23, Code of Federal Regu- 3 lations, is repealed. 4 SEC. 3. FEDERAL-AID HIGHWAYS EMERGENCY RELIEF 5 FUNDS. 6 Section 125 of title 23, United States Code, is 7 amended— 8 (1) by striking subsection (d)(4); and 9 (2) by adding at the end the following: 10 ‘‘(h) IMPOSITION OF DEADLINE.— 11 ‘‘(1) IN GENERAL.—Notwithstanding any other 12 provision of law, the Secretary of Transportation 13 may not require any project funded pursuant to this 14 section to advance to the construction obligation 15 stage before the date that is the last day of the sixth 16 fiscal year after the later of— 17 ‘‘(A) the date on which the Governor de- 18 clared the emergency, as described in subsection 19 (d)(1)(A); or 20 ‘‘(B) the date on which the President de- 21 clared the emergency to be a major disaster, as 22 described in such subsection. 23 ‘‘(2) EXTENSION OF DEADLINE.—If the Sec- 24 retary imposes a deadline for advancement to the 25 construction obligation stage pursuant to paragraph 26 VerDate Sep 11 2014 04:23 Jun 14, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3193.IH H3193 kjohnson on DSK79L0C42 with BILLS 3 •HR 3193 IH (1), the Secretary may, upon the request of the Gov- 1 ernor of the State, issue an extension of not more 2 than 1 year to complete such advancement, and may 3 issue additional extensions after the expiration of 4 any extension, if the Secretary determines the Gov- 5 ernor of the State has provided suitable justification 6 to warrant an extension.’’. 7 SEC. 4.
