Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Stamp Out Elder 4 Abuse Act of 2019’’. 5 SEC. 2. STAMP OUT ELDER ABUSE SEMIPOSTAL STAMP. 6 (a) DEFINITIONS.—In this section— 7 (1) the term ‘‘elder justice’’ has the meaning 8 given that term in section 2011 of the Social Secu- 9 rity Act (42 U.S.C. 1397j); 10 VerDate Sep 11 2014 06:26 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1784.IS S1784 kjohnson on DSK79L0C42 with BILLS 2 •S 1784 IS (2) the term ‘‘elder abuse’’ has the meaning 1 given that term in section 2 of the Elder Abuse Pre- 2 vention and Prosecution Act (34 U.S.C. 21701); 3 (3) the term ‘‘Postal Service’’ means the United 4 States Postal Service; 5 (4) the term ‘‘semipostal stamp’’ has the mean- 6 ing given the term ‘‘semipostal’’ in section 416(a)(1) 7 of title 39, United States Code; and 8 (5) the term ‘‘Stamp Out Elder Abuse Semi- 9 postal Stamp’’ means the semipostal stamp issued 10 under subsection (b). 11 (b) ISSUANCE.—In order to afford a convenient way 12 for members of the public to contribute to raising aware- 13 ness of and combating elder abuse and to funding for elder 14 justice activities, the Postal Service shall issue a semipost- 15 al stamp in accordance with subsection (c). 16 (c) TERMS AND CONDITIONS.— 17 (1) IN GENERAL.—Except as provided in this 18 subsection, the issuance and sale of, and the deter- 19 mination of amounts becoming available from the 20 sale of, the Stamp Out Elder Abuse Semipostal 21 Stamp shall be governed by section 416 of title 39, 22 United States Code, and regulations issued under 23 that section. 24 VerDate Sep 11 2014 06:26 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1784.IS S1784 kjohnson on DSK79L0C42 with BILLS 3 •S 1784 IS (2) DURATION.—The Postal Service shall make 1 available to the public the Stamp Out Elder Abuse 2 Semipostal Stamp for a period of not less than 2 3 years, beginning not later than 1 year after the date 4 of enactment of this Act. 5 (3) DISPOSITION OF PROCEEDS.— 6 (A) DEPARTMENT OF JUSTICE.—Half of 7 the amounts becoming available from the sale 8 of the Stamp Out Elder Abuse Semipostal 9 Stamp shall be transferred to the Department 10 of Justice, to remain available until expended, 11 for the purposes of— 12 (i) prevention of and education re- 13 garding elder abuse; 14 (ii) investigation, prosecution, and liti- 15 gation expenses relating to elder abuse; 16 (iii) data collection regarding elder 17 abuse; 18 (iv) elder abuse victim services; and 19 (v) any other expense of the Depart- 20 ment of Justice relating to elder abuse. 21 (B) ADMINISTRATION FOR COMMUNITY 22 LIVING.—Half of the amounts becoming avail- 23 able from the sale of the Stamp Out Elder 24 Abuse Semipostal Stamp shall be transferred to 25 VerDate Sep 11 2014 06:26 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1784.IS S1784 kjohnson on DSK79L0C42 with BILLS 4 •S 1784 IS the Department of Health and Human Services, 1 to remain available until expended, for the pur- 2 poses of elder justice activities authorized under 3 subtitle B of title XX of the Social Security Act 4 (42 U.S.C. 1397j et seq.). 5 (C) ADMINISTRATION OF TRANSFERS.— 6 Transfers under this paragraph shall be made 7 to the Department of Justice and the Depart- 8 ment of Health and Human Services not less 9 frequently than 2 times a year and under such 10 other arrangements as the Postal Service shall 11 by mutual agreement with the applicable agency 12 establish in order to carry out the purposes of 13 this Act. 14 (D) PROCEEDS NOT TO BE OFFSET.—In 15 accordance with section 416(d)(4) of title 39, 16 United States Code, amounts becoming avail- 17 able from the sale of the Stamp Out Elder 18 Abuse Semipostal Stamp shall not be taken into 19 account in any decision relating to the level of 20 appropriations or other Federal funding to be 21 furnished in any year to the Department of 22 Justice or the Department of Health and 23 Human Services. 24 VerDate Sep 11 2014 06:26 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1784.IS S1784 kjohnson on DSK79L0C42 with BILLS 5 •S 1784 IS (4) LIMITATION.—The Stamp Out Elder Abuse 1 Semipostal Stamp shall not be subject to, or taken 2 into account for purposes of applying, any limitation 3 under section 416(e)(1)(C) of title 39, United States 4 Code. 5 (5) PROMOTION.—The Department of Justice 6 and the Department of Health and Human Services 7 may use Federal funds to promote the sale of the 8 Stamp Out Elder Abuse Semipostal Stamp, which 9 may include the preparation and dissemination of re- 10 ports, brochures, or other appropriate materials to 11 be made available to the public that describe elder 12 justice issues and the benefits of the sale of the 13 Stamp Out Elder Abuse Semipostal Stamp. 14 Æ VerDate Sep 11 2014 06:26 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S1784.IS S1784 kjohnson on DSK79L0C42 with BILLS
