SHORT TITLE; TABLE OF CONTENTS. 3 (a) SHORT TITLE.—This Act may be cited as the 4 ‘‘Smart Technologies Advancing Reliable Transportation 5 Act’’ or the ‘‘START Act’’. 6 (b) TABLE OF CONTENTS.—The table of contents for 7 this Act is as follows: 8 Sec. 1. Reports to Secretary of Transportation and Congress. SEC. 2. PURPOSE. 1 The purpose of this Act is to promote smart tech- 2 nologies and systems to reduce transportation costs, traf- 3 fic congestion, air pollution, energy use, and carbon emis- 4 sions, and enhance security resiliency for communities of 5 all sizes by— 6 (1) creating a smart city and community trans- 7 portation resource guide; 8 (2) promoting the quality and performance of 9 smart city technologies while protecting— 10 (A) the physical and cyber security of data 11 and smart city technology systems; and 12 (B) privacy; and 13 (3) providing assistance to local governments 14 interested in implementing smart city or community 15 transportation technologies. 16 SEC. 3 DEFINITIONS. 17 In this Act: 18 (1) APPROPRIATE COMMITTEES OF CON- 19 GRESS.—The term ‘‘appropriate committees of Con- 20 gress’’ means— 21 (A) the Committee on Commerce, Science, 22 and Transportation of the Senate; and 23 VerDate Sep 11 2014 01:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3156.IH H3156 kjohnson on DSK79L0C42 with BILLS 3 •HR 3156 IH (B) the Committee on Transportation and 1 Infrastructure and the Committee on Energy 2 and Commerce of the House of Representatives. 3 (2) DATA.—The term ‘‘data’’ includes informa- 4 tion and images. 5 (3) LARGE-SIZED CITY.—The term ‘‘large-sized 6 city’’ means a beneficiary city with a population of 7 850,000 or greater, according to the most recent an- 8 nual estimates of resident population by the Bureau 9 of the Census. 10 (4) MEDIUM-SIZED CITY.—The term ‘‘medium- 11 sized city’’ means a beneficiary city with a popu- 12 lation between 200,000 and 850,000, according to 13 the most recent annual estimates of resident popu- 14 lation by the Bureau of the Census. 15 (5) RURAL AREA.—The term ‘‘rural area’’ 16 means a beneficiary jurisdiction with a population 17 between 10,000 and 75,000 people, not located with- 18 in an urbanized area or cluster, according to the 19 most recent annual estimates of resident population 20 by the Bureau of the Census. 21 (6) SECRETARIES.—The term ‘‘Secretaries’’ 22 means the Secretary, acting in coordination with— 23 (A) the Secretary of Energy; and 2 (C) the Director of the National Science 3 Foundation. 4 (7) SECRETARY.—The term ‘‘Secretary’’ means 5 the Secretary of Transportation. 6 (8) SECURITY SOLUTIONS.—The term ‘‘security 7 solutions’’ means video camera equipment, emer- 8 gency light and panic alarms, information technology 9 and information systems. 10 (9) SMALL CITY.—The term ‘‘small city’’ means 11 a beneficiary city with a population between 75,000 12 and 200,000, according to the most recent annual 13 estimates of resident population by the Bureau of 14 the Census. 15 (10) SMART CITY OR COMMUNITY.— 16 (A) IN GENERAL.—The term ‘‘smart city 17 or community’’ means a community in which 18 innovative, advanced, secure, and reliable infor- 19 mation and communication technologies and re- 20 lated mechanisms are applied— 21 (i) to improve the quality of life for 22 residents; 3 (iii) to promote economic growth; and 4 (iv) to create a community that is 5 safer and more secure, sustainable, resil- 6 ient, livable, and workable. 7 (B) INCLUSIONS.—The term ‘‘smart city 8 or community’’ includes a local jurisdiction that 9 installs smart city technology that— 10 (i) gathers and incorporates data from 11 systems, devices, and sensors embedded in 12 civic systems and infrastructure to improve 13 the effectiveness and efficiency of civic op- 14 erations and services; 15 (ii) aggregates and analyzes gathered 16 data; 17 (iii) communicates the analysis and 18 data in a variety of formats; 19 (iv) makes corresponding improve- 20 ments to civic systems and services based 21 on gathered data; 2 (II) to protect the private data of 3 residents; and 4 (III) to measure the impact of 5 smart city or community technologies 6 on the effectiveness and efficiency 7 civic operations and services. 8 (11) SMART CITY TECHNOLOGY.—The term 9 ‘‘smart city technology’’ means technology and sys- 10 tems that gather and incorporate data from systems, 11 devices, and sensors embedded in civic systems, se- 12 curity systems, transportation and traffic manage- 13 ment systems, and infrastructure to improve the ef- 14 fectiveness and efficiency of civic operations by— 15 (A) aggregating and analyzing collected 16 data; 17 (B) communicating the analysis and data 18 in a variety of forms; 19 (C) corresponding improvements to civic 20 systems and services based on gathered data; 21 (D) providing innovative services in mul- 22 tiple modes of transport and traffic manage- 23 ment to enable users to be safer, better coordi- 24 nated and connected, and better informed; 2 and 3 (ii) to measure the impact of smart 4 city or community technologies on the ef- 5 fectiveness and efficiency of civic oper- 6 ations and services. 7 (12) STATE.—The term ‘‘State’’ means— 8 (A) a State; 9 (B) the District of Columbia; 10 (C) the Commonwealth of Puerto Rico; 11 and 12 (D) any other territory or possession of the 13 United States. 14 (13) URBAN AREA.—The term ‘‘urban area’’ 15 means a area designated as an urbanized area by 16 the Bureau of the Census with a population of 17 50,000 residents or more. 18 SEC. 4 SMART CITY AND COMMUNITY TRANSPORTATION 19 RESOURCE GUIDE. 20 (a) PUBLICATION.— 21 (1) IN GENERAL.—The Secretaries, in coordina- 22 tion with the heads of any other applicable Federal 23 agencies, shall create, publish, and maintain a re- 24 source guide designed to assist States, communities, 25 VerDate Sep 11 2014 01:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H3156.IH H3156 kjohnson on DSK79L0C42 with BILLS 8 •HR 3156 IH and cities in developing and implementing smart city 1 or community programs. 2 (2) INFORMATION INCLUDED.—The Secretaries, 3 in coordination with representatives of cities, com- 4 munities, and industry entities, shall determine what 5 information shall be included in the guide described 6 in paragraph (1). 7 (b) REQUIREMENTS.—The guide published under 8 subsection (a)— 9 (1) shall be maintained electronically on a 10 website; 11 (2) shall be provided as an electronic reference 12 guide available to the public free of charge; and 13 (3) may include— 14 (A) available examples of local govern- 15 ments engaging private sector entities in order 16 to implement smart city or community solu- 17 tions, including public-private partnership mod- 18 els, that could be used to leverage private sector 19 funding, reduce transportation costs, and en- 20 hance security resiliency; 2 (C) Federal best practices for safeguarding 3 cybersecurity and physical security, and ensur- 4 ing appropriate data management and data pri- 5 vacy; and 6 (D) such other topics as are determined to 7 be necessary by the Secretaries. 8 (c) EXISTING GUIDES.—In creating, publishing, and 9 maintaining the guide under subsection (a), the Secre- 10 taries shall consider Federal guides published before, on, 11 or after the date of enactment of this Act relating to smart 12 city or community goals, activities, and best practices— 13 (1) to prevent duplication of efforts by the Fed- 14 eral Government; and 15 (2) to leverage existing complementary efforts. 16 SEC. 5. SMART CITIES CHALLENGE GRANT EXTENSION 17 PROGRAM. 18 (a) IN GENERAL.—Not later than 12 months after 19 the date of enactment of this Act, the Secretary of Trans- 20 portation shall develop and implement an additional round 21 to the Smart Cities Challenge under which the Secretary 22 shall provide grants on a competitive basis to small- and 23 medium-sized communities to implement smart transpor- 24 tation proposals. 25 VerDate Sep 11 2014 01:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H3156.IH H3156 kjohnson on DSK79L0C42 with BILLS 10 •HR 3156 IH (b) ELIGIBILITY.—To be eligible to receive a grant 1 under this section, an entity shall be— 2 (1) a State or local government; 3 (2) a tribal government; 4 (3) a transit agency or authority; 5 (4) a public toll authority; 6 (5) a metropolitan planning organization; 7 (6) any other subdivision of a State or local 8 government; or 9 (7) a multijurisdictional group applying through 10 a single lead applicant. 11 (c) APPLICATIONS.—An eligible entity seeking a 12 grant under this section shall submit to the Secretary an 13 application at the time, in such manner, and containing 14 such information as the Secretary may require. An eligible 15 entity may only submit 1 application. 16 (d) PRIORITY.—In selecting eligible entities to receive 17 grants under this section, the Secretary shall prioritize ap- 18 plicants that— 19 (1) identify transportation challenges and de- 20 scribe how smart city technologies and systems can 21 address such challenges; 22 (2) determine what technologies have the most 23 potential to address the challenges identified; 24 VerDate Sep 11 2014 01:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H3156.IH H3156 kjohnson on DSK79L0C42 with BILLS 11 •HR 3156 IH (3) identify what data may be collected and 1 analyzed using these technologies and how such data 2 would be used to continue to address identified 3 transportation challenges; 4 (4) incorporate relevant security solutions based 5 on the scope and necessity for such smart city 6 project; and 7 (5) comply with any other requirements that 8 the Secretary may identify. 9 (e) NON-FEDERAL SHARE.—The non-Federal share 10 of the cost of a project for which a grant is awarded under 11 this section shall be a minimum of 25 percent of the total 12 cost. 13 (f) AMOUNT OF GRANTS.—The amount of a grant 14 awarded under this section shall be a minimum of 15 $20,000,000 and a maximum of $40,000,000. The total 16 amount of funds awarded under this section shall not ex- 17 ceed $100,000,000 for one calendar year. 18 (g) AUTHORIZATION OF APPROPRIATIONS.—There is 19 authorized to be appropriated to carry out this section 20 $100,000,000 for each of fiscal years 2020 through 2024. 21 Additionally, the Secretary may reallocate unobligated 22 funds to carry out this section. 23 VerDate Sep 11 2014 01:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H3156.IH H3156 kjohnson on DSK79L0C42 with BILLS 12 •HR 3156 IH SEC. 6. GAO STUDY. 1 Not later than 1 year after the date of enactment 2 of this Act, the Comptroller General of the United States 3 shall conduct a study to identify— 4 (1) financial and procurement mechanisms cur- 5 rently available to public and private entities to fund 6 smart city or community activities and associated 7 demonstration projects, including ‘‘pay for perform- 8 ance’’ financing that could deliver measurable and 9 verifiable market and non-market values to smart 10 cities or communities; 11 (2) new, innovative financial and procurement 12 mechanisms under development or used experi- 13 mentally that may be available, in the near term, to 14 public and private entities to fund smart city or 15 community activities and associated demonstration 16 projects; 17 (3) barriers to creative financing solutions for 18 those activities and projects, including procurement 19 barriers faced by State and local governments; and 20 (4) ways to leverage private sector investments 21 in smart cities and communities. 22 SEC. 7.
