Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

That the following sums are appropriated, out of any
3
money in the Treasury not otherwise appropriated, for Ag-
4
riculture, Rural Development, Food and Drug Administra-
5
tion, and Related Agencies programs for fiscal year ending
6
September 30, 2020, and for other purposes, namely:

TITLE I

AGRICULTURAL PROGRAMS

PROCESSING, RESEARCH, AND MARKETING

OFFICE OF THE SECRETARY
11
(INCLUDING TRANSFERS OF FUNDS)

For necessary expenses of the Office of the Secretary,
13
$45,112,000, of which not to exceed $4,850,000 shall be
14
available for the Immediate Office of the Secretary; not
15
to exceed $1,448,000 shall be available for the Office of
16
Homeland Security; not to exceed $6,211,000 shall be
17
available for the Office of Partnerships and Public En-
18
gagement, of which $1,500,000 shall be for 7 U.S.C.
19
2279(c)(5); not to exceed $22,251,000 shall be available
20
for the Office of the Assistant Secretary for Administra-
21
tion, of which $21,376,000 shall be available for Depart-
22
mental Administration to provide for necessary expenses
23
for management support services to offices of the Depart-
24
ment and for general administration, security, repairs and

alterations, and other miscellaneous supplies and expenses

not otherwise provided for and necessary for the practical

and efficient work of the Department: Provided, That
3
funds made available by this Act to an agency in the Ad-
4
ministration mission area for salaries and expenses are
5
available to fund up to one administrative support staff
6
for the Office; not to exceed $3,091,000 shall be available
7
for the Office of Assistant Secretary for Congressional Re-
8
lations and Intergovernmental Affairs to carry out the
9
programs funded by this Act, including programs involv-
10
ing intergovernmental affairs and liaison within the execu-
11
tive branch; and not to exceed $7,261,000 shall be avail-
12
able for the Office of Communications: Provided further,
13
That the Secretary of Agriculture is authorized to transfer
14
funds appropriated for any office of the Office of the Sec-
15
retary to any other office of the Office of the Secretary:
16
Provided further, That no appropriation for any office
17
shall be increased or decreased by more than 5 percent:
18
Provided further, That not to exceed $22,000 of the
19
amount made available under this paragraph for the Im-
20
mediate Office of the Secretary shall be available for offi-
21
cial reception and representation expenses, not otherwise
22
provided for, as determined by the Secretary: Provided
23
further, That the amount made available under this head-
24
ing for Departmental Administration shall be reimbursed

from applicable appropriations in this Act for travel ex-

penses incident to the holding of hearings as required by
2
5 U.S.C. 551–558: Provided further, That funds made

available under this heading for the Office of the Assistant
4
Secretary for Congressional Relations and Intergovern-

mental Affairs may be transferred to agencies of the De-
6
partment of Agriculture funded by this Act to maintain
7
personnel at the agency level.

HAZARDOUS MATERIALS MANAGEMENT

For necessary expenses of the Department of Agri-

culture, to comply with the Comprehensive Environmental
8
Response, Compensation, and Liability Act (42 U.S.C.
9
9601 et seq.) and the Solid Waste Disposal Act (42 U.S.C.
10
6901 et seq.), $5,288,000, to remain available until ex-
11
pended: Provided, That appropriations and funds available
12
herein to the Department for Hazardous Materials Man-
13
agement may be transferred to any agency of the Depart-
14
ment for its use in meeting all requirements pursuant to
15
the above Acts on Federal and non-Federal lands.

Statistics Service, $180,794,000, of which up to

for the Census of Agriculture may be used to conduct Cur-
8
rent Industrial Report surveys subject to 7 U.S.C.
9
2204g(d) and (f).

AGRICULTURAL RESEARCH SERVICE

SALARIES AND EXPENSES

For necessary expenses of the Agricultural Research
13
Service and for acquisition of lands by donation, exchange,
14
or purchase at a nominal cost not to exceed $100, and
15
for land exchanges where the lands exchanged shall be of
16
equal value or shall be equalized by a payment of money
17
to the grantor which shall not exceed 25 percent of the
18
total value of the land or interests transferred out of Fed-
19
eral ownership, $1,347,516,000, of which $13,100,000, to
20
remain available until expended, shall be used for transi-
21
tion and equipment purchases for the National Bio and
22
Agro-Defense Facility located in Manhattan, Kansas: Pro-
23
vided, That of the amounts available to the Agricultural
24
Research Service for the National Bio and Agro-Defense

Facility, no funds may be obligated above the amount pro-

vided for the facility in P.L. 116–6 until the Secretary
2
of Agriculture submits to the Committees on Appropria-
3
tions of both Houses of Congress, and receives written or
4
electronic notification of receipt from such Committees, a
5
strategic plan as required in the report accompanying this
6
Act: Provided further, That appropriations hereunder shall
7
be available for the operation and maintenance of aircraft
8
and the purchase of not to exceed one for replacement
9
only: Provided further, That appropriations hereunder
10
shall be available pursuant to 7 U.S.C. 2250 for the con-
11
struction, alteration, and repair of buildings and improve-
12
ments, but unless otherwise provided, the cost of con-
13
structing any one building shall not exceed $500,000, ex-
14
cept for headhouses or greenhouses which shall each be
15
limited to $1,800,000, except for 10 buildings to be con-
16
structed or improved at a cost not to exceed $1,100,000
17
each, and except for two buildings to be constructed at
18
a cost not to exceed $3,000,000 each, and the cost of alter-
19
ing any one building during the fiscal year shall not exceed
20
10 percent of the current replacement value of the build-
21
ing or $500,000, whichever is greater: Provided further,
22
That appropriations hereunder shall be available for enter-
23
ing into lease agreements at any Agricultural Research
24
Service location for the construction of a research facility

any facility shall be owned, operated, and maintained by

the non-Federal entity and shall be removed upon the ex-

piration or termination of the lease agreement: Provided

further, That the limitations on alterations contained in

this Act shall not apply to modernization or replacement

of existing facilities at Beltsville, Maryland: Provided fur-

ther, That appropriations hereunder shall be available for
9
granting easements at the Beltsville Agricultural Research
10
Center: Provided further, That the foregoing limitations
11
shall not apply to replacement of buildings needed to carry
12
out the Act of April 24, 1948 (21 U.S.C. 113a): Provided
13
further, That appropriations hereunder shall be available
14
for granting easements at any Agricultural Research Serv-
15
ice location for the construction of a research facility by
16
a non-Federal entity for use by, and acceptable to, the
17
Agricultural Research Service and a condition of the ease-
18
ments shall be that upon completion the facility shall be
19
accepted by the Secretary, subject to the availability of
20
funds herein, if the Secretary finds that acceptance of the
21
facility is in the interest of the United States: Provided
22
further, That funds may be received from any State, other
23
political subdivision, organization, or individual for the
24
purpose of establishing or operating any research facility
