Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Homeownership for
4
DREAMers Act’’.
5
SEC. 2. DACA RECIPIENT ELIGIBILITY.
6
(a) FHA.—Section 203 of the National Housing Act
7
(12 U.S.C. 1709) is amended by inserting after subsection
8
(h) the following:
9
‘‘(i) DACA RECIPIENT ELIGIBILITY.—
10
‘‘(1) IN GENERAL.—The Secretary may not—
11
‘‘(A) prescribe terms that limit the eligi-
12
bility of a single family mortgage for insurance
13
under this title because of the status of the mort-
14
gagor as a DACA recipient; or
15
‘‘(B) issue any limited denial of participa-
16
tion in the program for such insurance because
17
of the status of the mortgagor as a DACA recipi-
18
ent.

‘‘(2) DACA RECIPIENT DEFINED.—For the pur-
20
poses of this subsection, the term ‘DACA recipient’
21
means an alien who, at any time before, on, or after
22
the date of the enactment of this subsection, is or was
23
in deferred action status pursuant to the Deferred Ac-
24
tion for Childhood Arrivals (‘DACA’) Program an-

‘‘(3) EXEMPTION.—

‘‘(A) DENIAL
FOR
FAILURE
TO
SATISFY
4
VALID ELIGIBILITY REQUIREMENTS.—Nothing in
5
this title prohibits the denial of insurance based
6
on failure to satisfy valid eligibility require-
7
ments.
8
‘‘(B)
INVALID
ELIGIBILITY
REQUIRE-
9
MENTS.—Valid eligibility requirements do not
10
include criteria that were adopted with the pur-
11
pose of denying eligibility for insurance because
12
of race, color, religion, sex, familial status, na-
13
tional origin, disability, or the status of a mort-
14
gagor as a DACA recipient.’’.

(b) RURAL HOUSING SERVICE.—Section 501 of the
16
Housing Act of 1949 (42 U.S.C. 1472) is amended by add-
17
ing at the end the following:
18
‘‘(k) DACA RECIPIENT ELIGIBILITY.—
19
‘‘(1) IN GENERAL.—The Secretary may not pre-
20
scribe terms that limit eligibility for a single family
21
mortgage made, insured, or guaranteed under this
22
title because of the status of the mortgagor as a DACA
23
recipient.

poses of this paragraph, the term ‘DACA recipient’
2
means an alien who, at any time before, on, or after
3
the date of the enactment of this paragraph, is or was
4
in deferred action status pursuant to the Deferred Ac-
5
tion for Childhood Arrivals (‘DACA’) Program an-
6
nounced by the Secretary of Homeland Security on
7
June 15, 2012.’’.

(c) FANNIE MAE.—Section 302(b) of the National
9
Housing Act (12 U.S.C. 1717(b)) is amended by adding at
10
the end the following:

‘‘(8) DACA RECIPIENT ELIGIBILITY.—
12
‘‘(A) IN GENERAL.—The corporation may
13
not condition purchase of a single-family resi-
14
dence mortgage by the corporation under this
15
subsection on the status of the borrower as a
16
DACA recipient.

‘‘(B) DACA RECIPIENT DEFINED.—For the
18
purposes of this paragraph, the term ‘DACA re-
19
cipient’ means an alien who, at any time before,
20
on, or after the date of the enactment of this
21
paragraph, is or was in deferred action status
22
pursuant to the Deferred Action for Childhood
23
Arrivals (‘DACA’) Program announced by the
