RULEMAKING TO INSTALL AUTOMATIC SHUTOFF 1 SYSTEMS AND ROLLAWAY PREVENTION 2 TECHNOLOGY IN MOTOR VEHICLES. 3 (a) DEFINITIONS.—In this section: 4 (1) KEY.—The term ‘‘key’’ has the meaning 5 given the term in section 571.114 of title 49, Code 6 of Federal Regulations (or successor regulations). 7 (2) MANUFACTURER.—The term ‘‘manufac- 8 turer’’ has the meaning given the term in section 9 30102(a) of title 49, United States Code. 10 (3) MOTOR VEHICLE.— 11 (A) IN GENERAL.—The term ‘‘motor vehi- 12 cle’’ has the meaning given the term in section 13 30102(a) of title 49, United States Code. 14 (B) EXCLUSIONS.—The term ‘‘motor vehi- 15 cle’’ does not include— 16 (i) a motorcycle or trailer (as those 17 terms are defined in section 571.3 of title 18 49, Code of Federal Regulations) (or suc- 19 cessor regulations); or 20 (ii) any motor vehicle that is rated at 21 more than 10,000 pounds gross vehicular 22 weight. 23 (4) SECRETARY.—The term ‘‘Secretary’’ means 24 the Secretary of Transportation. 25 VerDate Sep 11 2014 05:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3145.IH H3145 kjohnson on DSK79L0C42 with BILLS 3 •HR 3145 IH (b) AUTOMATIC SHUTOFF SYSTEMS FOR MOTOR VE- 1 HICLES.— 2 (1) FINAL RULE.— 3 (A) IN GENERAL.—Not later than 2 years 4 after the date of enactment of this Act, the Sec- 5 retary shall issue a final rule amending section 6 571.114 of title 49, Code of Federal Regula- 7 tions (relating to Federal Motor Vehicle Safety 8 Standard Number 114), to require manufactur- 9 ers to install technology in each motor vehicle 10 equipped with a keyless ignition device and an 11 internal combustion engine to automatically 12 shut off the motor vehicle after the motor vehi- 13 cle has idled for the period designated under 14 subparagraph (B). 15 (B) PERIOD DESCRIBED.— 16 (i) IN GENERAL.—The period referred 17 to in subparagraph (A) is the period des- 18 ignated by the Administrator of the Na- 19 tional Highway Traffic Safety Administra- 20 tion as necessary to prevent carbon mon- 21 oxide poisoning. 22 (ii) DIFFERENT PERIODS.—The Ad- 23 ministrator of the National Highway Traf- 24 fic Safety Administration may designate 25 VerDate Sep 11 2014 05:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3145.IH H3145 kjohnson on DSK79L0C42 with BILLS 4 •HR 3145 IH different periods under clause (i) for dif- 1 ferent types of motor vehicles, depending 2 on the rate at which the motor vehicle 3 emits carbon monoxide, if— 4 (I) the Administrator determines 5 a different period is necessary for a 6 type of motor vehicle for purposes of 7 section 30111 of title 49, United 8 States Code; and 9 (II) requiring a different period 10 for a type of motor vehicle is con- 11 sistent with the prevention of carbon 12 monoxide poisoning. 13 (2) DEADLINE.—The rule under paragraph (1) 14 shall become effective on September 1 of the year 15 that is 1 year after the date on which the Secretary 16 issued that rule. 17 (c) PREVENTING MOTOR VEHICLES FROM ROLLING 18 AWAY.— 19 (1) REQUIREMENT.—Not later than 2 years 20 after the date of enactment of this Act, the Sec- 21 retary shall issue a final rule amending part 571 of 22 title 49, Code of Federal Regulations, requiring 23 manufacturers to install technology in motor vehicles 24 equipped with keyless ignition devices and automatic 25 VerDate Sep 11 2014 05:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3145.IH H3145 kjohnson on DSK79L0C42 with BILLS 5 •HR 3145 IH transmissions to prevent movement of the motor ve- 1 hicle if— 2 (A) the transmission of the motor vehicle 3 is not in the park setting; 4 (B) the motor vehicle does not exceed the 5 speed determined by the Secretary under para- 6 graph (2); 7 (C) the door for the operator of the motor 8 vehicle is open; 9 (D) the seat belt of the operator of the 10 motor vehicle is unbuckled; and 11 (E) the service brake of the motor vehicle 12 is not engaged. 13 (2) DETERMINATION.—The Secretary shall de- 14 termine the maximum speed at which a motor vehi- 15 cle may be safely locked in place under the condi- 16 tions described in subparagraphs (A), (C), (D), and 17 (E) of paragraph (1) to prevent vehicle rollaways. 18 (3) DEADLINE.—The rule under paragraph (1) 19 shall become effective on September 1 of the year 20 that is 1 year after the date on which the Secretary 21 issues that rule. 22 Æ VerDate Sep 11 2014 05:02 Jun 13, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H3145.IH H3145 kjohnson on DSK79L0C42 with BILLS
