To reauthorize the Clean School Bus Program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Clean Commute for
4
Kids Act of 2019’’.
5
SEC. 2. REAUTHORIZATION OF CLEAN SCHOOL BUSES PRO-
6
GRAM.
7
(a) DEFINITIONS.—
8
(1) ALTERNATIVE FUEL.—Section 741(a)(2) of
9
the Energy Policy Act of 2005 (42 U.S.C. 16091(a))
10
is amended—

(A) in subparagraph (B), by striking ‘‘or’’

all that follows through ‘‘(B) is operated’’ and in-

serting ‘‘that is operated’’.

(b) PROGRAM FOR RETROFIT OR REPLACEMENT OF

CERTAIN

SCHOOL
BUSES
WITH
CLEAN

SCHOOL BUSES.—

(1) PRIORITY OF GRANT APPLICATIONS.—Sec-
16
tion 741(b)(2) of the Energy Policy Act of 2005 (42
17
U.S.C. 16091(b)(2)) is amended—
18
(A) in subparagraph (A), by inserting be-
19
fore the period at the end ‘‘with clean school
20
buses with low or zero emissions’’; and
21
(B) by amending subparagraph (B) to read
22
as follows:

‘‘(B) RETROFITTING.—In the case of
1
grant applications to retrofit school buses, the
2
Administrator shall give—
3
‘‘(i) highest priority to applicants that
4
propose to retrofit school buses manufac-
5
tured in or after model year 1991 to be-
6
come clean school buses with low or zero
7
emissions; and
8
‘‘(ii) second highest priority to appli-
9
cants that otherwise propose to retrofit
10
school buses manufactured in or after
11
model year 1991 to become clean school
12
buses.’’.

(2) USE
OF
SCHOOL
BUS
FLEET.—Section
14
741(b)(3)(B) of the Energy Policy Act of 2005 (42
15
U.S.C. 16091(b)(3)(B)) is amended by inserting
16
‘‘charged,’’ after ‘‘operated,’’.
17
(3) REPLACEMENT GRANTS.—Paragraph (5) of
18
section 741(b) of the Energy Policy Act of 2005 (42
19
U.S.C. 16091(b)) is amended to read as follows:
20
‘‘(5) REPLACEMENT GRANTS.—In the case of
21
grants to replace school buses—
22
‘‘(A) the Administrator may award the
23
grants for up to 60 percent of the replacement
24
costs; and

‘‘(B) such replacement costs may include
1
the costs of acquiring the clean school buses
2
and charging and fueling infrastructure.’’.

(4) ULTRA LOW-SULFUR DIESEL FUEL.—Sec-
4
tion 741(b) of the Energy Policy Act of 2005 (42
5
U.S.C. 16091(b)) is amended—
6
(A) by striking paragraph (6); and
7
(B) by redesignating paragraphs (7) and
8
(8) as paragraphs (6) and (7), respectively.
9
(c) EDUCATION.—Paragraph (1) of section 741(c) of
10
the Energy Policy Act of 2005 (42 U.S.C. 16091(c)) is
11
amended to read as follows:

‘‘(1) IN
GENERAL.—Not later than 90 days
13
after the date of enactment of the Clean Commute
14
for Kids Act of 2019, the Administrator shall de-
15
velop an education outreach program to promote and
16
explain the grant program under subsection (b), as
17
amended by such Act.’’.

(d) AUTHORIZATION OF APPROPRIATIONS.—Section
19
741(d) of the Energy Policy Act of 2005 (42 U.S.C.
20
16091(d)) is amended by striking ‘‘until expended—’’ and
21
all that follows through the end of the subsection and in-
22
serting ‘‘until expended, $50,000,000 for each of fiscal
23
years 2021 through 2025.’’.
