A BILL
To amend the Nuclear Waste Policy Act of 1982 to prioritize
the acceptance of high-level radioactive waste or spent
nuclear fuel from certain civilian nuclear power reactors,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Spent Fuel Prioritiza-

tion Act of 2019’’.

SEC. 2. ACCEPTANCE PRIORITY FOR HIGH-LEVEL RADIO-

ACTIVE WASTE AND SPENT NUCLEAR FUEL.

Section 302(a) of the Nuclear Waste Policy Act of
3
1982 (42 U.S.C. 10222(a)) is amended by adding at the
4
end the following:
5
‘‘(7) In determining the order in which the Secretary
6
will accept high-level radioactive waste or spent nuclear
7
fuel for disposal or storage, the Secretary shall prioritize
8
waste or spent fuel from a civilian nuclear power reactor
9
based on the operating status of the reactor, the popu-
10
lation of the area in which the reactor is located, and the
11
earthquake hazard of the area in which the reactor is lo-
12
cated, giving highest priority to a reactor that is—
13
‘‘(A) decomissioned or decommissioning;
14
‘‘(B) located in an area, as determined by the
15
Secretary, the population of which is the largest; and
16
‘‘(C) located in an area with the highest hazard
17
of an earthquake, as indicated by the Seismic Haz-
18
ard Maps published by the Director of the United
19
States Geological Survey pursuant to section
20
5(b)(3)(J) of the Earthquake Hazards Reduction
21
Act of 1977.’’.
