Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Know Conflicts Act 4 of 2019’’. 5 SEC. 2. FULL DISCLOSURE OF ENTITIES RECEIVING FED- 6 ERAL FUNDING. 7 Section 2 of the Federal Funding Accountability and 8 Transparency Act of 2006 (31 U.S.C. 6101 note) is 9 amended— 10 VerDate Sep 11 2014 23:19 Jun 06, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2950.IH H2950 kjohnson on DSK79L0C42 with BILLS 2 •HR 2950 IH (1) in subsection (a)— 1 (A) by redesignating— 2 (i) paragraphs (6) through (8) as 3 paragraphs (9) through (11), respectively; 4 and 5 (ii) paragraphs (1) through (4) as 6 paragraphs (3) through (7), respectively; 7 (B) by inserting before paragraph (2), as 8 redesignated, the following: 9 ‘‘(1) ACTIVE FINANCIAL CONFLICT OF INTER- 10 EST.—The term ‘active financial conflict of interest’ 11 means any potential source of conflict that con- 12 stitutes a financial interest in or liability owed to an 13 entity reported as receiving a Federal award under 14 this Act. 15 ‘‘(2) COVERED PERSON.—The term ‘covered 16 person’ means the President, Vice President, the 17 spouse of the President, the spouse of the Vice 18 President, a dependent child of the President, or a 19 dependent child of the Vice President.’’; and 20 (C) by inserting after paragraph (7), as re- 21 designated the following: 22 ‘‘(8) POTENTIAL SOURCE OF CONFLICT.—The 23 term ‘potential source of conflict’ means any finan- 24 VerDate Sep 11 2014 23:19 Jun 06, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2950.IH H2950 kjohnson on DSK79L0C42 with BILLS 3 •HR 2950 IH cial interest or liability held by a covered person 1 that— 2 ‘‘(A)(i) is not a financial interest described 3 in section 102(f)(8) of the Ethics in Govern- 4 ment Act of 1978 (5 U.S.C. App.); and 5 ‘‘(ii) is included in a covered person’s fi- 6 nancial disclosure report required to be filed 7 under section 101 of the Ethics in Government 8 Act of 1978 (5 U.S.C. App.); or 9 ‘‘(iii) is otherwise identified by the Director 10 of the Office of Government Ethics as a poten- 11 tial source of conflict.’’; and 12 (2) in subsection (b)(1)— 13 (A) in subparagraph (F)(ii), by striking 14 the period at the end and inserting a semicolon; 15 (B) by redesignating subparagraph (G) as 16 subparagraph (H); and 17 (C) by inserting after subparagraph (F) 18 the following: 19 ‘‘(G) information indicating whether a 20 Federal award has resulted in the existence of 21 one or more active financial conflicts of interest; 22 and’’. 23 VerDate Sep 11 2014 23:19 Jun 06, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2950.IH H2950 kjohnson on DSK79L0C42 with BILLS 4 •HR 2950 IH SEC. 3.
