and Ms. COLLINS) introduced the following bill; which was read twice and
referred to the Committee on Environment and Public Works
A BILL
To amend the Clean Air Act to modify the definition of
‘‘renewable biomass’’ under the renewable fuel program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. DEFINITION OF RENEWABLE BIOMASS UNDER
3
RENEWABLE FUEL PROGRAM.
4
Section 211(o)(1)(I) of the Clean Air Act (42 U.S.C.
5
7545(o)(1)(I)) is amended—
6
(1) by redesignating clauses (iii) through (vii)
7
as clauses (v) through (ix), respectively; and
8
(2) by striking clause (ii) and inserting the fol-
9
lowing:

‘‘(ii) Trees and tree residue from non-
1
Federal land, including land belonging to
2
an Indian tribe or an Indian individual
3
that is held in trust by the United States
4
or subject to a restriction against alien-
5
ation imposed by the United States.
6
‘‘(iii) Any secondary, residual mate-
7
rials generated from forest products manu-
8
facturing, including, but not limited to,
9
sawdust, wood chips, shavings, bark, san-
10
derdust, and trimmings, regardless of
11
whether the source of primary materials is
12
derived from Federal or non-Federal land.
13
‘‘(iv) Biomass materials obtained from
14
Federal land that—
15
‘‘(I) are not harvested from old
16
growth stands, unless the old growth
17
stand is part of a science-based eco-
18
logical restoration project authorized
19
by the Secretary of Agriculture or the
20
Secretary of the Interior, as applica-
21
ble, that meets applicable protection
22
and old growth enhancement objec-
23
tives, as determined by the applicable
24
Secretary;

‘‘(II) are slash, precommercial

thinnings, or derived from ecological
2
restoration activities;
3
‘‘(III) are harvested in a manner
4
consistent with applicable Federal
5
laws (including regulations) and land
6
management plans; and
7
‘‘(IV) are derived within—
8
‘‘(aa)
the
wildland-urban
9
interface (as defined in section
10
101 of the Healthy Forests Res-
11
toration Act of 2003 (16 U.S.C.
12
6511)) from acreage included
13
within a community wildfire pro-
14
tection plan (as so defined);
15
‘‘(bb) a priority area on
16
Federal land, as identified by the
17
Secretary of Agriculture or the
18
Secretary of the Interior, as ap-
19
plicable, in need of—
20
‘‘(AA) ecological res-
21
toration;
22
‘‘(BB) an authorized
23
hazardous fuels reduction
24
project under section 102 of
