A BILL
To include nonprofit and volunteer ground and air ambulance
crew members and first responders for certain benefits.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Emergency Medical
4
Service Providers Protection Act’’.
5
SEC. 2. ELIGIBILITY.
6
Section 1204 of title I of the Omnibus Crime Control
7
and Safe Streets Act of 1968 (34 U.S.C. 10284) is amend-
8
ed—

(1) in paragraph (7) to read as follows:

‘‘(7) ‘member of a rescue squad or ambulance
1
crew’ means an officially recognized or designated
2
employee or volunteer member of a rescue squad or
3
ambulance crew (including a ground or air ambu-
4
lance service) that—
5
‘‘(A) is a public agency; or
6
‘‘(B) is (or is a part of) a nonprofit or pri-
7
vate, for-profit entity serving the public that is
8
officially authorized or licensed to engage in
9
rescue activity or to provide emergency medical
10
services; and
11
‘‘(i) engages in rescue activities or
12
provides emergency medical services as
13
part of an official emergency response sys-
14
tem; or
15
‘‘(ii) is officially designated as a pre-
16
hospital emergency medical response agen-
17
cy;’’; and
18
(2) in paragraph (9), by inserting after ‘‘and by
19
the applicable agency or entity’’ the following: ‘‘(and
20
as designated by such agency or entity)’’.

SEC. 3. OFFSET.

Of the unobligated balances available under the De-
23
partment of Justice Assets Forfeiture Fund, $12,000,000
24
are permanently cancelled.

SEC. 4. EFFECTIVE DATE.

The amendments made by section 2 shall apply only
2
to injuries sustained on or after March 1, 2007, and shall
3
take effect beginning on the date that is 90 days after
4
the date of enactment of this Act. Any person who had
5
made an application under part L of title I of the Omnibus
6
Crime Control and Safe Streets Act of 1968 and whose
7
application was denied by reason of the date an injury was
8
sustained may reapply.

SEC. 5. CONFORMING AMENDMENT.
10
Section 1086(d)(2)(A) of the National Defense Au-
11
thorization Act for Fiscal Year 2013 (Public Law 112–
12
239) is amended by striking ‘‘June 1, 2009’’ and inserting
13
‘‘March 25, 2007’’.
