A BILL
To establish a grant program to incentivize States to reduce
prison populations, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Reverse Mass Incarcer-
4
ation Act of 2019’’.

SEC. 2. GRANT PROGRAM.

(a) IN GENERAL.—Title I of the Omnibus Crime
7
Control and Safe Street Act of 1968 (42 U.S.C. 3711 et
8
seq.) is amended by adding at the end the following:

‘‘PART OO—STATE PRISON POPULATION

REDUCTION GRANT PROGRAM

‘‘SEC. 3051. GRANT PROGRAM.
3
‘‘(a) IN GENERAL.—The Attorney General may make
4
grants to States to assist States in reducing crime rates
5
and incarcerations.
6
‘‘(b) ELIGIBILITY.—A State shall be eligible to re-
7
ceive a grant under this section if the State demonstrates
8
that, during the 3-year period preceding the application
9
for a grant under this section—
10
‘‘(1) the total number of individuals incarcer-
11
ated in correctional or detention facilities in the
12
State was reduced by not less than 7 percent; and
13
‘‘(2) the rate of crime within the State did not
14
increase by more than 3 percent.

‘‘(c) APPLICATION.—An eligible State seeking a
16
grant under this section shall submit to the Attorney Gen-
17
eral an application in such form and manner and at such
18
time as the Attorney General requires, which shall include
19
a clear methodology based on population size and other
20
factors.

‘‘(d) USE
OF GRANT FUNDS.—A grant awarded
22
under this section shall be used by a State to implement
23
evidence-based programs designed to reduce crime rates
24
and incarcerations.’’.

(b) AUTHORIZATION OF APPROPRIATIONS.—Section
1
1001(a) of title I of the Omnibus Crime Control and Safe
2
Streets Act of 1968 (42 U.S.C. 3793(a)) is amended by
3
adding at the end the following:
4
‘‘(28) There are authorized to be appropriated to
5
carry out part OO $2,000,000,000 for each of fiscal years
6
2020 through 2029.’’.
