Mr. HEINRICH introduced the following bill; which was read twice and referred
to the Committee on Energy and Natural Resources
A BILL
To establish the White Sands National Park in the State
of New Mexico as a unit of the National Park System,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. ESTABLISHMENT OF WHITE SANDS NATIONAL

PARK.
4
(a) DEFINITIONS.—In this section:
5
(1)
MONUMENT.—The
term
‘‘Monument’’
6
means the White Sands National Monument, New
7
Mexico, established by Presidential Proclamation
8
No. 2025 (54 U.S.C. 320301 note), dated January
9
18, 1933, and administered by the Secretary.

(2) PARK.—The term ‘‘Park’’ means the White

Sands National Park established by subsection (b).
2
(3) SECRETARY.—The term ‘‘Secretary’’ means
3
the Secretary of the Interior.

(b) ESTABLISHMENT.—To protect, preserve, and re-
5
store its scenic, scientific, educational, natural, geological,
6
historical,
cultural,
archaeological,
paleontological,
7
hydrological, fish, wildlife, and recreational values and to
8
enhance visitor experiences, there is established in the
9
State of New Mexico the White Sands National Park as
10
a unit of the National Park System.

(c) ABOLISHMENT
OF WHITE SANDS NATIONAL

MONUMENT.—
13
(1) ABOLISHMENT.—Due to the establishment
14
of the Park, the Monument is abolished.
15
(2) INCORPORATION.—The land and interests
16
in land that comprise the Monument are incor-
17
porated in, and shall be considered to be part of, the
18
Park.

(d) REFERENCES.—Any reference in a law, map, reg-
20
ulation, document, paper, or other record of the United
21
States to the ‘‘White Sands National Monument’’ shall be
22
considered to be a reference to the ‘‘White Sands National
23
Park’’.

(e) AVAILABILITY OF FUNDS.—Any funds available
1
for the Monument shall be available for the Park.
2
(f) ADMINISTRATION.—The Secretary shall admin-
3
ister the Park in accordance with—
4
(1) this section; and
5
(2) the laws generally applicable to units of the
6
National Park System, including section 100101(a),
7
chapter 1003, sections 100751(a), 100752, 100753,
8
and 102101, and chapter 3201 of title 54, United
9
States Code.

(g) WORLD HERITAGE LIST NOMINATION.—
11
(1) COUNTY
CONCURRENCE.—The Secretary
12
shall not submit a nomination for the Park to be in-
13
cluded on the World Heritage List of the United
14
Nations Educational, Scientific and Cultural Organi-
15
zation unless each county in which the Park is lo-
16
cated concurs in the nomination.
17
(2) ARMY NOTIFICATION.—Before submitting a
18
nomination for the Park to be included on the World
19
Heritage List of the United Nations Educational,
20
Scientific and Cultural Organization, the Secretary
21
shall notify the Secretary of the Army of the intent
22
of the Secretary to nominate the Park.
23
(h) EFFECT.—Nothing in this section affects—

(1) valid existing rights (including water
1
rights);
2
(2) permits or contracts issued by the Monu-
3
ment;
4
(3) existing agreements, including agreements
5
with the Department of Defense;
6
(4) the jurisdiction of the Department of De-
7
fense regarding the restricted airspace above the
8
Park; or
9
(5) the airshed classification of the Park under
10
the Clean Air Act (42 U.S.C. 7401 et seq.).
