Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. REPEAL OF CERTAIN LAWS RELATED TO SWITCH- 1 BLADE KNIVES. 2 (a) IN GENERAL.—The Act entitled ‘‘An Act to pro- 3 hibit the introduction, or manufacture for introduction, 4 into interstate commerce of switchblade knives, and for 5 other purposes’’, approved August 12, 1958 (commonly 6 known as the ‘‘Federal Switchblade Act’’; 15 U.S.C. 1241 7 et seq.), is amended by striking sections 1 through 4. 8 (b) CONFORMING AMENDMENTS.—Chapter 83 of 9 title 18, United States Code, is amended— 10 (1) in section 1716— 11 (A) by striking subsection (g); 12 (B) by redesignating subsections (h) 13 through (k) as subsections (g) through (j), re- 14 spectively; and 15 (C) by striking subsection (h), as so redes- 16 ignated, and inserting the following: 17 ‘‘(h)(1) All ballistic knives are nonmailable and shall 18 not be deposited in or carried by the mails or delivered 19 by any officer or employee of the Postal Service. Such 20 knives may be conveyed in the mails, under such regula- 21 tions as the Postal Service shall prescribe— 22 ‘‘(A) to civilian or Armed Forces supply or pro- 23 curement officers and employees of the Federal Gov- 24 ernment ordering, procuring, or purchasing such 25 VerDate Sep 11 2014 04:14 May 30, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1588.IS S1588 kjohnson on DSK79L0C42 with BILLS 3 •S 1588 IS knives in connection with the activities of the Fed- 1 eral Government; 2 ‘‘(B) to supply or procurement officers of the 3 National Guard, the Air National Guard, or militia 4 of a State ordering, procuring, or purchasing such 5 knives in connection with the activities of such orga- 6 nizations; 7 ‘‘(C) to supply or procurement officers or em- 8 ployees of any State, or any political subdivision of 9 a State or Territory, ordering, procuring, or pur- 10 chasing such knives in connection with the activities 11 of such government; and 12 ‘‘(D) to manufacturers of such knives or bona 13 fide dealers therein in connection with any shipment 14 made pursuant to an order from any person des- 15 ignated in subparagraphs (A), (B), and (C). 16 ‘‘(2) As used in this subsection, the term ‘ballistic 17 knife’ means a knife with a detachable blade that is pro- 18 pelled by a spring-operated mechanism.’’; and 19 (2) in section 1716E(i), by striking ‘‘section 20 1716(k)’’ and inserting ‘‘section 1716(j)’’. 21 (c) EFFECTIVE DATE.—The amendments made by 22 this section— 23 (1) shall take effect on the date of enactment 24 of this Act; and 25 VerDate Sep 11 2014 04:14 May 30, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1588.IS S1588 kjohnson on DSK79L0C42 with BILLS 4 •S 1588 IS (2) shall not apply with respect to any indict- 1 ment, conviction, sentencing, appeal, civil or criminal 2 fine or penalty obtained, forfeiture obtained, term of 3 imprisonment, or any other enforcement action or 4 proceeding occurring or commenced before the date 5 of enactment of this Act. 6 Æ VerDate Sep 11 2014 04:14 May 30, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S1588.IS S1588 kjohnson on DSK79L0C42 with BILLS
