A BILL
To establish a Corps of Engineers Flood Control Civilian
Advisory Council, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Corps of Engineers
4
Flood Control Civilian Advisory Council Act’’.
5
SEC. 2. CORPS OF ENGINEERS FLOOD CONTROL.

(a) ADVISORY COUNCIL.—
7
(1) IN GENERAL.—There is established a Corps
8
of Engineers Flood Control Civilian Advisory Coun-

cil (referred to in this section as the ‘‘Advisory
1
Council’’).
2
(2) MEMBERSHIP.—
3
(A) IN GENERAL.—The Advisory Council
4
shall be composed of—
5
(i) 2 members from each of—
6
(I) the State of Montana;
7
(II) the State of North Dakota;
8
(III) the State of South Dakota;
9
(IV) the State of Nebraska;
10
(V) the State of Iowa;
11
(VI) the State of Kansas; and
12
(VII) the State of Missouri; and
13
(ii) representatives of—
14
(I) the agriculture industry;
15
(II) the river commerce industry;
16
and
17
(III) other related industries, as
18
determined by the President.

(B) SELECTION.—Members of the Advi-
20
sory Council shall be appointed by the Presi-
21
dent, based on the recommendations of the Sen-
22
ators of the States described in subparagraph
23
(A)(i).

(C) DEADLINE.—Members of the Advisory
1
Council shall be appointed by not later than 90
2
days after the date of enactment of this Act.
3
(3) MEETING.—The first meeting of the Advi-
4
sory Council shall be not later than 90 days after
5
the date of enactment of this Act.
6
(4) DUTIES.—The Advisory Council shall—
7
(A) develop recommendations on how to
8
best revise the Missouri River Mainstem Res-
9
ervoir System Master Water Control Manual to
10
prioritize flood control and navigation;
11
(B) submit to the Secretary of the Army,
12
the Committee on Environment and Public
13
Works of the Senate, and the Committee on
14
Transportation and Infrastructure of the House
15
of Representatives a report that includes those
16
recommendations; and
17
(C) make the report under subparagraph
18
(B) publicly available.

(5) COMPENSATION.—
20
(A) IN GENERAL.—Except as provided in
21
subparagraph (B), the members of the Advisory
22
Council shall serve without compensation.
23
(B) TRAVEL EXPENSES.—The members of
24
the Advisory Council shall be allowed travel ex-

penses, including per diem in lieu of subsist-
1
ence, at rates authorized for employees of agen-
2
cies under subchapter I of chapter 57 of title 5,
3
United States Code, while away from their
4
homes or regular places of business in the per-
5
formance of services for the Advisory Council.
6
(C) TREATMENT.—The members of the
7
Advisory Council shall not be considered to be
8
Federal employees.
9
(6) NO NEW FUNDS.—No new funds are au-
10
thorized to be appropriated to carry out this sub-
11
section.

(7) TERMINATION.—The Advisory Council shall
13
terminate on the date that is 1 year after the date
14
of the first meeting of the Advisory Council under
15
paragraph (3).
16
(b) REVISION.—To the maximum extent practicable
17
and after considering the recommendations of the Advi-
18
sory Council under subsection (a)(4), the Chief of Engi-
19
neers shall revise the Missouri River Mainstem Reservoir
20
System Master Water Control Manual to prioritize flood
21
control and navigation.
