A BILL
To amend the Workforce Innovation and Opportunity Act
to provide funding, on a competitive basis, for summer
and year-round employment opportunities for youth ages
14 through 24.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Creating Pathways for
4
Youth Employment Act’’.
5
SEC. 2. YOUTH EMPLOYMENT OPPORTUNITIES.

Title I of the Workforce Innovation and Opportunity
7
Act is amended—

Opportunities

‘‘SEC. 176. DEFINITIONS.
6
‘‘In this subtitle:
7
‘‘(1) ELIGIBLE
YOUTH.—The term ‘eligible
8
youth’ means an individual who—
9
‘‘(A) is not younger than age 14 or older
10
than age 24; and
11
‘‘(B) is—
12
‘‘(i) an in-school youth;
13
‘‘(ii) an out-of-school youth; or
14
‘‘(iii) an unemployed individual.
15
‘‘(2) HARDEST-TO-EMPLOY,
MOST-AT-RISK.—
16
The term ‘hardest-to-employ, most-at-risk’, used
17
with respect to an individual, includes individuals
18
who are homeless, in foster care, involved in the ju-
19
venile or criminal justice system, or are not enrolled
20
in or at risk of dropping out of an educational insti-
21
tution and who live in an underserved community
22
that has faced trauma through acute or long-term
23
exposure to substantial discrimination, historical or
24
cultural oppression, intergenerational poverty, civil

unrest, a high rate of violence, or a high rate of

drug overdose mortality.

‘‘(3) INDIAN TRIBE; TRIBAL ORGANIZATION.—
3
The terms ‘Indian tribe’ and ‘tribal organization’
4
have the meanings given the terms in section 4 of
5
the Indian Self-Determination and Education Assist-
6
ance Act (25 U.S.C. 5304).

‘‘(4)
IN-SCHOOL
YOUTH;
OUT-OF-SCHOOL
8
YOUTH.—The terms ‘in-school youth’ and ‘out-of-
9
school youth’ have the meanings given the terms in
10
section 129(a)(1).
11
‘‘(5) INSTITUTION OF HIGHER EDUCATION.—
12
The term ‘institution of higher education’ has the
13
meaning given the term in section 101 of the Higher
14
Education Act of 1965 (20 U.S.C. 1001).
15
‘‘(6) SUBSIDIZED
EMPLOYMENT.—The term
16
‘subsidized employment’ means employment for
17
which the employer receives a total or partial sub-
18
sidy to offset costs of employing an eligible youth
19
under this subtitle.

‘‘(7) TRIBAL
AREA.—The term ‘tribal area’
21
means—
22
‘‘(A) an area on or adjacent to an Indian
23
reservation;

‘‘(B) land held in trust by the United
1
States for Indians;
2
‘‘(C) a public domain Indian allotment;
3
‘‘(D) a former Indian reservation in Okla-
4
homa; and
5
‘‘(E) land held by an incorporated Native
6
group, Regional Corporation, or Village Cor-
7
poration under the provisions of the Alaska Na-
8
tive Claims Settlement Act (43 U.S.C. 1601 et
9
seq.).
10
‘‘(8) TRIBAL COLLEGE OR UNIVERSITY.—The
11
term ‘tribal college or university’ has the meaning
12
given the term ‘Tribal College or University’ in sec-
13
tion 316(b) of the Higher Education Act of 1965
14
(20 U.S.C. 1059c(b)).
15
‘‘(9) TRIBALLY
DESIGNATED
HOUSING
ENTI-
16
TY.—The term ‘tribally designated housing entity’,
17
used with respect to an Indian tribe (as defined in
18
this section), has the meaning given in section 4 of
19
the Native American Housing Assistance and Self-
20
Determination Act of 1996 (25 U.S.C. 4103).
21
‘‘SEC. 176A. ALLOCATION OF FUNDS.
22
‘‘(a) ALLOCATION.—Of the funds appropriated under
23
section 176E that remain available after any reservation
24
under subsection (b), the Secretary may make available—

‘‘(1) not more than $1,500,000,000 in accord-
1
ance with section 176B to provide eligible youth with
2
subsidized summer employment opportunities; and
3
‘‘(2) not more than $2,000,000,000 in accord-
4
ance with section 176C to provide eligible youth with
5
subsidized year-round employment opportunities.
6
‘‘(b) RESERVATION.—The Secretary may reserve not
7
more than 10 percent of the funds appropriated under sec-
8
tion 176E to provide technical assistance and oversight,
9
in order to assist eligible entities in applying for and ad-
10
ministering grants awarded under this subtitle.

‘‘SEC. 176B. SUMMER EMPLOYMENT COMPETITIVE GRANT
12
PROGRAM.
13
‘‘(a) IN GENERAL.—
14
‘‘(1) GRANTS.—Using the amounts made avail-
15
able under 176A(a)(1), the Secretary shall award,
16
on a competitive basis, planning and implementation
17
grants.
18
‘‘(2) GENERAL USE OF FUNDS.—The Secretary
19
shall award the grants to assist eligible entities by
20
paying for the program share of the cost of—
21
‘‘(A) in the case of a planning grant, plan-
22
ning a summer youth employment program to
23
provide subsidized summer employment oppor-
24
tunities; and

‘‘(B) in the case of an implementation
1
grant, implementation of such a program, to
2
provide such opportunities.
3
‘‘(b) PERIODS AND AMOUNTS OF GRANTS.—
4
‘‘(1) PLANNING GRANTS.—The Secretary may
5
award a planning grant under this section for a 1-
6
year period, in an amount of not more than
7
$200,000.
8
‘‘(2) IMPLEMENTATION
GRANTS.—The Sec-
9
retary may award an implementation grant under
10
this section for a 3-year period, in an amount of not
11
more than $5,000,000.
12
‘‘(c) ELIGIBLE ENTITIES.—
13
‘‘(1) IN GENERAL.—To be eligible to receive a
14
planning or implementation grant under this section,
15
an entity shall—
16
‘‘(A) be a—
17
‘‘(i) State, local government, or Indian
18
tribe or tribal organization, that meets the
19
requirements of paragraph (2); or
20
‘‘(ii) community-based organization
21
that meets the requirements of paragraph
22
(3); and

‘‘(B) meet the requirements for a planning
1
or implementation grant, respectively, specified
2
in paragraph (4).
3
‘‘(2) GOVERNMENT PARTNERSHIPS.—An entity
4
that is a State, local government, or Indian tribe or
5
tribal organization referred to in paragraph (1) shall
6
demonstrate that the entity has entered into a part-
7
nership with State, local, or tribal entities—
8
‘‘(A) that shall include—
9
‘‘(i) a local educational agency or trib-
10
al educational agency (as defined in section
11
6132 of the Elementary and Secondary
12
Education Act of 1965 (20 U.S.C. 7452));
13
‘‘(ii) a local board or tribal workforce
14
development agency;
15
‘‘(iii) a State, local, or tribal agency
16
serving youth under the jurisdiction of the
17
juvenile justice system or criminal justice
18
system;
19
‘‘(iv) a State, local, or tribal child wel-
20
fare agency;
21
‘‘(v) a State, local, or tribal agency or
22
community-based organization, with—
23
‘‘(I) expertise in providing coun-
24
seling services, and trauma-informed

and gender-responsive trauma preven-
1
tion, identification, referral, and sup-
2
port (including treatment) services;
3
and
4
‘‘(II) a proven track record of
5
serving low-income vulnerable youth
6
and out-of-school youth; and
7
‘‘(vi) if the State, local government, or
8
Indian tribe or tribal organization is seek-
9
ing an implementation grant, and has not
10
established a summer youth employment
11
program, an entity that is carrying out a
12
State, local, or tribal summer youth em-
13
ployment program; and
14
‘‘(vii) an employer or employer asso-
15
ciation; and
16
‘‘(B) that may include—
17
‘‘(i) an institution of higher education
18
or tribal college or university;
19
‘‘(ii) a representative of a labor or
20
labor-management organization;
21
‘‘(iii) an entity that carries out a pro-
22
gram that receives funding under the Juve-
23
nile Justice and Delinquency Prevention
24
Act of 1974 (42 U.S.C. 5601 et seq.) or

section 212 of the Second Chance Act of
1
2007 (42 U.S.C. 17532);
2
‘‘(iv) a collaborative applicant as de-
3
fined in section 401 of the McKinney-
4
Vento Homeless Assistance Act (42 U.S.C.
5
11360) or a private nonprofit organization
6
that serves homeless individuals and house-
7
holds (including such an applicant or orga-
8
nization that serves individuals or house-
9
holds that are at risk of homelessness in
10
tribal areas) or serves foster youth;
11
‘‘(v) an entity that carries out a pro-
12
gram funded under the Carl D. Perkins
13
Career and Technical Education Act of
14
2006 (20 U.S.C. 2301 et seq.), including
15
Native American programs funded under
16
section 116 of that Act (20 U.S.C. 2326)
17
and tribally controlled postsecondary ca-
18
reer and technical institution programs
19
funded under section 117 of that Act (20
20
U.S.C. 2327);
21
‘‘(vi) a local or tribal youth com-
22
mittee;

‘‘(vii) a State or local public housing

agency or a tribally designated housing en-
2
tity; and
3
‘‘(viii)
another
appropriate
State,
4
local, or tribal agency.

‘‘(3) COMMUNITY-BASED ORGANIZATION PART-
6
NERSHIPS.—A community-based organization re-
7
ferred to in paragraph (1) shall demonstrate that
8
the organization has entered into a partnership with
9
State, local, or tribal entities—
10
‘‘(A) that shall include—
11
‘‘(i) a unit of general local government
12
or tribal government;
13
‘‘(ii) an agency described in para-
14
graph (2)(A)(i);
15
‘‘(iii) a local board or tribal workforce
16
development agency;
17
‘‘(iv) a State, local, or tribal agency
18
serving youth under the jurisdiction of the
19
juvenile justice system or criminal justice
20
system;
21
‘‘(v) a State, local, or tribal child wel-
22
fare agency;
23
‘‘(vi) if the organization is seeking an
24
implementation grant, and has not estab-

State, local, or tribal summer youth em-

ployment program; and
4
‘‘(vii) an employer or employer asso-
5
ciation; and

‘‘(B) that may include one or more entities

described in paragraph (2)(B).

‘‘(4) ENTITIES
ELIGIBLE
FOR
PARTICULAR

GRANTS.—

‘‘(A) ENTITIES ELIGIBLE FOR PLANNING
11
GRANTS.—The Secretary may award a planning
12
grant under this section to an eligible entity
13
that—
14
‘‘(i) is preparing to establish or ex-
15
pand a summer youth employment pro-
16
gram that meets the minimum require-
17
ments specified in subsection (d); and
18
‘‘(ii) has not received a grant under
19
this section.
20
‘‘(B) ENTITIES ELIGIBLE FOR IMPLEMEN-
21
TATION GRANTS.—
22
‘‘(i) IN
GENERAL.—The Secretary
23
may award an implementation grant under
24
this section to an eligible entity that—
25

‘‘(I) has received a planning
1
grant under this section; or
2
‘‘(II) has established a summer
3
youth employment program and dem-
4
onstrates a minimum level of capacity
5
to enhance or expand the summer
6
youth employment program described
7
in the application submitted under
8
subsection (d).

‘‘(ii)
CAPACITY.—In
determining
10
whether an entity has the level of capacity
11
referred to in clause (i)(II), the Secretary
12
may include as capacity—
13
‘‘(I) the entity’s staff capacity
14
and staff training to deliver youth em-
15
ployment services; and
16
‘‘(II) the entity’s existing youth
17
employment services (as of the date of
18
submission of the application sub-
19
mitted under subsection (d)) that are
20
consistent with the application.
21
‘‘(d) APPLICATION.—
22
‘‘(1) IN GENERAL.—Except as provided in para-
23
graph (2), an eligible entity desiring to receive a
24
grant under this section for a summer youth employ-

ment program shall submit an application to the

Secretary at such time, in such manner, and con-
2
taining such information as the Secretary may re-
3
quire, including, at a minimum, each of the fol-
4
lowing:
5
‘‘(A) With respect to an application for a
6
planning or implementation grant—
7
‘‘(i) a description of the eligible youth
8
for whom summer employment services will
9
be provided;
10
‘‘(ii) a description of the eligible enti-
11
ty, and a description of the expected par-
12
ticipation and responsibilities of each of
13
the partners in the partnership described
14
in subsection (c);
15
‘‘(iii) information demonstrating suffi-
16
cient need for the grant in the State, local,
17
or tribal population, which may include in-
18
formation showing—
19
‘‘(I) a high level of unemploy-
20
ment among youth (including young
21
adults) ages 14 through 24;
22
‘‘(II) a high rate of out-of-school
23
youth;
