TESTING FOR PFAS. 1 Section 1445 of the Safe Drinking Water Act (42 2 U.S.C. 300j–4) is amended by adding at the end the fol- 3 lowing: 4 ‘‘(k) MONITORING FOR PFAS IN PUBLIC WATER 5 SYSTEMS.— 6 ‘‘(1) IN GENERAL.—The Administrator shall, 7 not later than 6 months after the date of enactment 8 of this subsection, promulgate regulations that re- 9 quire, beginning not later than one year after such 10 date of enactment, monitoring for perfluoroalkyl and 11 polyfluoroalkyl substances with at least one fully 12 fluorinated carbon atom— 13 ‘‘(A) by all public water systems serving 14 10,000 persons or more; 15 ‘‘(B) with respect to public water systems 16 serving between 3,300 and 10,000 persons— 17 ‘‘(i) by all such public water systems, 18 if appropriations are available to cover the 19 reasonable cost of such testing and labora- 20 tory analysis as are necessary to carry out 21 the monitoring; or 22 ‘‘(ii) by a representative sample of 23 such public water systems, if such appro- 24 priations are not available; and 25 VerDate Sep 11 2014 04:47 May 29, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2800.IH H2800 kjohnson on DSK79L0C42 with BILLS 3 •HR 2800 IH ‘‘(C) by a representative sample of public 1 water systems serving fewer than 3,300 per- 2 sons. 3 ‘‘(2) PUBLIC AVAILABILITY OF RESULTS.—All 4 results of monitoring carried out under this sub- 5 section shall be accessible to the public and posted 6 online by the Administrator. 7 ‘‘(3) COVERED PFAS.—The Administrator shall 8 require under the regulations promulgated under 9 paragraph (1)— 10 ‘‘(A) during the period beginning on the 11 effective date of such regulations and ending on 12 the date test methods are validated under para- 13 graph (4), monitoring for at least 30 14 perfluoroalkyl and polyfluoroalkyl substances 15 with at least one fully fluorinated carbon atom; 16 and 17 ‘‘(B) beginning on the date test methods 18 are validated under paragraph (4), monitoring 19 for the total amount of all perfluoroalkyl and 20 polyfluoroalkyl substances with at least one 21 fully fluorinated carbon atom. 22 ‘‘(4) VALIDATED TEST METHODS.—Not later 23 than two years after the date of enactment of this 24 subsection, the Administrator shall validate one or 25 VerDate Sep 11 2014 04:47 May 29, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2800.IH H2800 kjohnson on DSK79L0C42 with BILLS 4 •HR 2800 IH more test methods for monitoring the total amount 1 of all perfluoroalkyl and polyfluoroalkyl substances 2 with at least one fully fluorinated carbon atom in 3 public water systems. 4 ‘‘(5) AUTHORIZATION OF APPROPRIATIONS.— 5 There are authorized to be appropriated 6 $10,000,000 for each of fiscal years 2021 through 7 2031 to the Administrator to pay the reasonable 8 cost of such testing and laboratory analysis as are 9 necessary to carry out monitoring required under 10 this subsection by public water systems serving 11 fewer than 10,000 persons.’’. 12 Æ VerDate Sep 11 2014 04:47 May 29, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2800.IH H2800 kjohnson on DSK79L0C42 with BILLS
