SHORT TITLE. 3 This Act may be cited as the ‘‘No President is Above 4 the Law Act of 2020’’. 5 SEC. 2. TOLLING OF STATUTE OF LIMITATIONS. 6 (a) OFFENSES COMMITTED BY THE PRESIDENT OR 7 VICE PRESIDENT DURING OR PRIOR TO TENURE IN OF- 8 FICE.—Section 3282 of title 18, United States Code, is 9 amended by adding at the end the following: 10 ‘‘(c) OFFENSES COMMITTED BY THE PRESIDENT OR 11 VICE PRESIDENT DURING OR PRIOR TO TENURE IN OF- 12 FICE.—In the case of any person serving as President or 13 Vice President of the United States, the duration of that 14 person’s tenure in office shall not be considered for purposes 15 of any statute of limitations applicable to any Federal 16 criminal offense committed by that person (including any 17 offenses committed during any period of time preceding 18 such tenure in office).’’. 19 (b) APPLICABILITY.—The amendments made by sub- 20 section (a) shall apply to any offense committed before the 21 date of the enactment of this section, if the statute of limita- 22 tions applicable to that offense had not run as of such date. 23 VerDate Sep 11 2014 20:59 Dec 31, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6203 E:\BILLS\H2678.RH H2678 pamtmann on DSKBC07HB2PROD with BILLS Union Calendar No. 589 116TH CONGRESS 2D SESSION H.
