To amend title 38, United States Code, to clarify that the
estate of a deceased veteran may receive certain accrued
benefits upon the death of the veteran, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Veterans Estate
4
Transfer to Survivors Act’’.

SEC. 2. CLARIFICATION OF ELIGIBLE RECIPIENTS OF CER-

TAIN ACCRUED BENEFITS UPON DEATH OF
2
BENEFICIARY.

(a) ELIGIBILITY OF ESTATE.—Section 5121(a)(2) of
4
title 38, United States Code, is amended—
5
(1) in the matter preceding subparagraph (A),
6
by inserting ‘‘, or estate,’’ after ‘‘person’’; and
7
(2) by adding at the end the following new sub-
8
paragraph:

‘‘(D) The estate of the veteran (unless the
10
estate will escheat).’’.
11
(b) EFFECTIVE DATE.—The amendment made by
12
subsection (a) shall apply with respect to the death of an
13
individual on or after the date of the enactment of this
14
Act.
