EXPANSION OF BROADBAND ACCESS. 6 Title I of the Communications Act of 1934 (47 7 U.S.C. 151 et seq.) is amended by adding at the end the 8 following new section: 9 ‘‘SEC. 14. EXPANSION OF BROADBAND ACCESS. 10 ‘‘(a) PROGRAM ESTABLISHED.—Not later than 180 11 days after the date of the enactment of this section, the 12 Commission, in consultation with the Assistant Secretary, 13 shall establish a program to expand access to broadband 14 for unserved areas, underserved areas, and unserved an- 15 chor institutions in accordance with the requirements of 16 this section that— 17 ‘‘(1) is separate from any universal service pro- 18 gram established pursuant to section 254; and 19 ‘‘(2) does not require funding recipients to be 20 designated as eligible telecommunications carriers 21 under section 214(e). 22 ‘‘(b) USE OF PROGRAM FUNDS.— 23 ‘‘(1) EXPANDING ACCESS TO BROADBAND 24 THROUGH NATIONAL REVERSE AUCTION.—Not later 25 VerDate Sep 11 2014 02:50 Jun 04, 2019 Jkt 034408 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2741.IH H2741 pbinns on DSK79D2C42PROD with BILLS 7 •HR 2741 IH than 18 months after the date of the enactment of 1 this section, the Commission shall award 75 percent 2 of the amounts appropriated under subsection (h) 3 through a national reverse auction to funding recipi- 4 ents only to expand access to broadband in unserved 5 areas. 6 ‘‘(2) EXPANDING ACCESS TO BROADBAND 7 THROUGH STATES.— 8 ‘‘(A) DISTRIBUTION OF FUNDS TO 9 STATES.—Not later than 255 days after the 10 date of the enactment of this section, the Com- 11 mission shall distribute 25 percent of the 12 amounts appropriated under subsection (h) 13 among the States, in direct proportion to the 14 population of each State. 15 ‘‘(B) PUBLIC NOTICE.—Not later than 195 16 days after the date of the enactment of this sec- 17 tion, the Commission shall issue a public notice 18 informing each State and the public of the 19 amounts to be distributed under this para- 20 graph. The notice shall include— 21 ‘‘(i) the manner in which a State shall 22 inform the Commission of that State’s ac- 23 ceptance or acceptance in part of the 24 VerDate Sep 11 2014 02:50 Jun 04, 2019 Jkt 034408 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2741.IH H2741 pbinns on DSK79D2C42PROD with BILLS 8 •HR 2741 IH amounts to be distributed under this para- 1 graph; 2 ‘‘(ii) the date (which is 30 days after 3 the date on which the public notice is 4 issued) by which such acceptance or ac- 5 ceptance in part is due; and 6 ‘‘(iii) the requirements as set forth 7 under this section and as may be further 8 prescribed by the Commission. 9 ‘‘(C) ACCEPTANCE BY STATES.—Not later 10 than 30 days after the date on which the public 11 notice is issued under subparagraph (B), each 12 State accepting amounts to be distributed 13 under this paragraph shall inform the Commis- 14 sion of the acceptance or acceptance in part by 15 the State of the amounts to be distributed 16 under this paragraph in the manner described 17 by the Commission in the public notice. 18 ‘‘(D) REQUIREMENTS FOR STATE RECEIPT 19 OF AMOUNTS DISTRIBUTED.—Each State ac- 20 cepting amounts distributed under this para- 21 graph— 22 ‘‘(i) shall only award such amounts 23 through a statewide reverse auction or auc- 24 tions, in the manner prescribed by the 25 VerDate Sep 11 2014 02:50 Jun 04, 2019 Jkt 034408 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H2741.IH H2741 pbinns on DSK79D2C42PROD with BILLS 9 •HR 2741 IH State but subject to the requirements as 1 set forth under this section and as may be 2 further prescribed by the Commission; 3 ‘‘(ii) shall make such awards only— 4 ‘‘(I) to funding recipients to ex- 5 pand access to broadband in unserved 6 areas; 7 ‘‘(II) to funding recipients to ex- 8 pand access to broadband to unserved 9 anchor institutions; or 10 ‘‘(III) to funding recipients to ex- 11 pand access to broadband in under- 12 served areas, but only if a State does 13 not have, or no longer has, any 14 unserved areas; 15 ‘‘(iii) shall conduct separate reverse 16 auctions for awards made to unserved an- 17 chor institutions under clause (ii)(II), if a 18 State awards any funding provided by this 19 section to unserved anchor institutions; 20 ‘‘(iv) shall return any unused portion 21 of such amounts to the Commission within 22 10 years after the date of the enactment of 23 this section and shall submit a certification 24 to the Commission before receiving such 25 VerDate Sep 11 2014 02:50 Jun 04, 2019 Jkt 034408 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H2741.IH H2741 pbinns on DSK79D2C42PROD with BILLS 10 •HR 2741 IH amounts that the State will return such 1 amounts; and 2 ‘‘(v) may not use more than 5 percent 3 of the amounts distributed under this 4 paragraph to administer a reverse auction 5 or auctions authorized by this paragraph. 6 ‘‘(E) DISTRIBUTION OF REMAINING 7 FUNDS.—In the case of any amounts remaining 8 after the amounts appropriated are distributed 9 as described in subparagraph (A), the Commis- 10 sion shall transfer such amounts to the grant 11 program established under section 159 of the 12 National Telecommunications and Information 13 Administration Organization Act. 14 ‘‘(3) COORDINATION OF FEDERAL AND STATE 15 FUNDING.—The Commission shall establish proc- 16 esses through the rulemaking under subsection (e) 17 to— 18 ‘‘(A) enable States to conduct statewide re- 19 verse auctions as part of, or in coordination 20 with, the national reverse auction; 21 ‘‘(B) assist States in conducting statewide 22 reverse auctions; 23 ‘‘(C) coordinate with States to ensure that 24 program funds awarded by the Commission and 25 VerDate Sep 11 2014 02:50 Jun 04, 2019 Jkt 034408 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BI [Text truncated for display.
