schools under the food donation program, and for other purposes.

A BILL
To amend the Richard B. Russell National School Lunch
Act to clarify that charitable organization officials may
receive food donations from schools under the food dona-
tion program, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Feeding Hungry Stu-
4
dents in Schools Act of 2019’’.

SEC. 2. FOOD DONATION BY SCHOOLS THROUGH CHARI-

TABLE ORGANIZATION OFFICIALS.

Section 9(l) of the Richard B. Russell National
3
School Lunch Act (42 U.S.C. 1758(l)) is amended—
4
(1) in paragraph (1)—
5
(A) by inserting ‘‘, including from a fund-
6
raiser or charitable food drive, or’’ after ‘‘any
7
food’’;
8
(B) by striking ‘‘GENERAL.—Each’’ and
9
inserting the following: ‘‘GENERAL.—
10
‘‘(A) FOOD
DONATIONS
PERMISSIBLE.—
11
Each’’; and
12
(C) by adding at the end the following:
13
‘‘(B) DONATIONS
THROUGH
CHARITABLE
14
ORGANIZATION OFFICIALS.—
15
‘‘(i) IN GENERAL.—Each school par-
16
ticipating in the school lunch program
17
under this Act may donate the food de-
18
scribed in subparagraph (A) to a charitable
19
organization through a charitable organiza-
20
tion official who is directly affiliated with
21
the school and the local educational agency
22
serving such school.

‘‘(ii) ANNUAL

ING.—A charitable organization official

may not receive donated food pursuant to

this subparagraph unless such charitable
1
organization official has received a food
2
safety certification, or other applicable cer-
3
tification, from the State health depart-
4
ment in the State such food is donated in.
5
‘‘(C) USE OF SCHOOL CAMPUS.—The food
6
donated by a school pursuant to this paragraph
7
may be received, stored, and distributed on the
8
campus of such school.

‘‘(D) CHARITABLE
ORGANIZATION
OFFI-
10
CIAL DEFINED.—In this paragraph, the term
11
‘charitable organization official’ means a person
12
who has a memorandum of understanding with
13
a charitable organization to receive food dona-
14
tions on behalf of such organization.’’; and
15
(2) in paragraph (2)(B), by inserting ‘‘, includ-
16
ing guidance with respect to donations through char-
17
itable
organization
officials
under
paragraph
18
(1)(B).’’ after ‘‘necessary’’.
