Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. REQUIREMENT TO PUBLISH ON INTERNET BASIS 1 FOR LISTINGS. 2 Section 4(b) of the Endangered Species Act of 1973 3 (16 U.S.C. 1533(b)) is amended by adding at the end the 4 following: 5 ‘‘(9) PUBLICATION ON INTERNET OF BASIS FOR 6 LISTINGS.— 7 ‘‘(A) IN GENERAL.—Except as provided in 8 subparagraph (B), the Secretary shall make 9 publicly available on the internet the best sci- 10 entific and commercial data available that are 11 the basis for each regulation, including each 12 proposed regulation, promulgated under sub- 13 section (a)(1). 14 ‘‘(B) EXCEPTION.—At the request of a 15 Governor or legislature of a State, the Sec- 16 retary shall not make available under subpara- 17 graph (A) information regarding which the 18 State has determined public disclosure is pro- 19 hibited by a law of that State relating to the 20 protection of personal information.’’. 21 Æ VerDate Sep 11 2014 22:45 May 22, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\S1429.IS S1429 khammond on DSKBBV9HB2PROD with BILLS
