What Changes
If this bill becomes law, the federal government will begin working with private companies to use their traffic and travel data to make highways work better. However, the government cannot use this data to issue traffic tickets or enforce traffic laws against drivers. The Secretary of Transportation must tell Congress each year what the program is accomplishing.

Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Intelligent Transpor-
4
tation Integration Act’’.
5
SEC. 2. THIRD-PARTY DATA INTEGRATION PROGRAM.
6
(a) IN GENERAL.—Not later than 180 days after en-
7
actment of this Act, the Secretary of Transportation shall
8
implement a program (in this section referred to as the
9
‘‘program’’) to leverage anonymized data from third-party
10
entities to improve transportation management capabilities
11
and efficiency on Federal-aid highways.
12
(b) PURPOSES.—The Secretary shall enable the use of
13
anonymized data derived from third-party entities—
14
(1) to inform infrastructure planning decisions
15
relating to—
16
(A) reducing congestion;
17
(B) decreasing miles traveled;
18
(C) increasing safety;
19
(D) improving freight efficiency;
20
(E) reducing wait times at freight facilities;
21
and
22
(F) enhancing environmental conditions;
23
(2) to facilitate integrated traffic management
24
systems that leverage real-time data to provide dy-

namic and efficient traffic flow management for the
1
purposes of—
2
(A) adjusting traffic light cycle times to op-
3
timize traffic management and decrease conges-
4
tion;
5
(B) expanding or contracting lane capacity
6
to meet traffic demand;
7
(C) enhancing traveler notification of serv-
8
ice conditions;
9
(D) prioritizing high-priority vehicles such
10
as emergency response and law enforcement
11
within the transportation system; and
12
(E) responding to severe weather events or
13
conducting emergency evacuations; and
14
(3) for any other purpose the Secretary deter-
15
mines is necessary to improve transportation man-
16
agement capabilities and efficiency on Federal-aid
17
highways and other assets on the nation’s transpor-
18
tation system.
19
(c) PARTNERSHIP; CONSULTATION.—
20
(1) IN GENERAL.—The Secretary is authorized to
21
enter into agreements with public and private sector
22
entities to accomplish the purposes described in sub-
23
section (b).

(2) REQUIREMENTS.—Any agreement entered
1
into under paragraph (1) between the Secretary and
2
a data provider shall—
3
(A) be disclosed to the public; and
4
(B) include provisions that require the use
5
of data protections for consumer privacy.
6
(3) CONSULTATION.—In carrying out the pro-
7
gram, the Secretary shall consult with at least 1 orga-
8
nization that supports the development of intelligent
9
transportation systems in the public and private sec-
10
tors.
11
(d) DATA PRIVACY AND ACCURACY.—In carrying out
12
the program, the Secretary shall issue guidance on—
13
(1) the protection of privacy for all consumers
14
and sources of data utilized in the program by—
15
(A) preventing reidentification of consumer
16
data;
17
(B) precluding the sources from providing
18
the program with biometric, electronic logging
19
device, or automatic license plate reader data;
20
and
21
(C) preventing data utilized in the program
22
from being used by any government entity for
23
any purpose other than the purposes described in
24
subsection (b) (including for automated traffic

enforcement, red light camera systems, and speed
1
camera systems); and
2
(2) the accuracy of data utilized in the program
3
by preventing—
4
(A) hacking, spoofing, and disruption of
5
connected and automated transportation systems;
6
and
7
(B) the incorporation of inaccurate data,
8
including inaccurate data generated by artificial
9
intelligence.
10
(e) PROGRAM LOCATIONS.—In carrying out the pro-
11
gram, the Secretary shall enter into agreements with public
12
and private sector entities serving a variety of areas, in-
13
cluding urban, suburban, rural, tribal, or any other appro-
14
priate settings.
15
(f) BEST PRACTICES.—Not later than 3 years after
16
date of enactment of this Act, the Secretary shall publicly
17
make available best practices to leverage private consumer
18
data to support improved transportation management ca-
19
pabilities and efficiency, including—
20
(1) legal considerations when acquiring private
21
consumer data for public purposes; and
22
(2) protecting privacy and security of individual
23
consumer data.

(g) EFFECTIVE
IMPLEMENTATION.—The Secretary
1
may take such actions as necessary to maximize the effective
2
implementation of this Act, including consolidating re-
3
quirements under this Act within other activities of the De-
4
partment of Transportation.
5
(h) REPORT.—The Secretary shall submit an annual
6
report to the Committee on Transportation and Infrastruc-
7
ture of the House of Representatives and the Committee on
8
Environment and Public Works of the Senate detailing—
9
(1) a description of the activities carried out
10
under the program;
11
(2) an evaluation of the effectiveness of the pro-
12
gram in meeting the purposes described in subsection
13
(b);
14
(3) policy recommendations to improve the im-
15
plementation of anonymized data into planning deci-
16
sions; and
17
(4) a description of costs associated with equip-
18
ping and maintaining integrated traffic management
19
systems.
