Protecting Communities from New PFAS Act

Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Protecting Commu- 4 nities from New PFAS Act’’. 5 SEC. 2. MANUFACTURING AND PROCESSING NOTICES FOR 6 PER- AND POLYFLUOROALKYL SUBSTANCES. 7 Section 5 of the Toxic Substances Control Act (15 8 U.S.C. 2604) is amended— 9 VerDate Sep 11 2014 22:07 May 16, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2596.IH H2596 kjohnson on DSK79L0C42 with BILLS 2 •HR 2596 IH (1) in subsection (h), by adding at the end the 1 following: 2 ‘‘(7) This subsection does not apply to any chemical 3 substance that is a perfluoroalkyl or polyfluoroalkyl sub- 4 stance.’’. 5 (2) by adding at the end the following: 6 ‘‘(j) PER- AND POLYFLUOROALKYL SUBSTANCES.— 7 ‘‘(1) DETERMINATION.—Any chemical sub- 8 stance that is a perfluoroalkyl or polyfluoroalkyl sub- 9 stance for which a notice is submitted under sub- 10 section (a) shall be deemed to have been determined 11 by the Administrator to present an unreasonable 12 risk of injury to health or the environment under 13 paragraph (3)(A) of such subsection. 14 ‘‘(2) ORDER.—Notwithstanding subsection 15 (a)(3)(A), for a chemical substance described in 16 paragraph (1) of this subsection, the Administrator 17 shall issue an order under subsection (f)(3) to pro- 18 hibit the manufacture, processing, and distribution 19 in commerce of such chemical substance.’’. 20 Æ VerDate Sep 11 2014 22:07 May 16, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H2596.IH H2596 kjohnson on DSK79L0C42 with BILLS
