SHORT TITLE. 1 This Act may be cited as the ‘‘American Indian and 2 Alaska Native Child Abuse Prevention and Treatment 3 Act’’ or the ‘‘AI/AN CAPTA’’. 4 SEC. 2. GOVERNMENT ACCOUNTABILITY OFFICE REPORT 5 ON CHILD ABUSE AND NEGLECT IN INDIAN 6 TRIBAL COMMUNITIES. 7 (a) IN GENERAL.—The Comptroller General of the 8 United States (referred to in this section as the ‘‘Comp- 9 troller General’’) shall conduct a study and issue a report 10 on child abuse and neglect in Indian Tribal communities 11 for the purpose of identifying vital information and mak- 12 ing recommendations to the appropriate congressional 13 committees concerning issues relating to child abuse and 14 neglect in such communities. 15 (b) CONSULTATION WITH INDIAN TRIBES.—In car- 16 rying out this section, the Comptroller General shall con- 17 sult with Indian Tribes from each of the 12 regions of 18 the Bureau of Indian Affairs. 19 (c) DUTIES.—Not later than 2 years after the date 20 of enactment of this Act, the Comptroller General shall 21 submit to the Committee on Health, Education, Labor, 22 and Pensions and the Committee on Indian Affairs of the 23 Senate and the Committee on Education and Labor and 24 the Committee on Natural Resources of the House of Rep- 25 resentatives a report on— 26 VerDate Sep 11 2014 02:33 May 14, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 \\ALPHA3\E\BILLS\H2549.IH H2549 kjohnson on DSK79L0C42 with BILLS 3 •HR 2549 IH (1) the number of Indian Tribes providing pri- 1 mary child abuse and neglect prevention activities; 2 (2) the number of Indian tribes providing sec- 3 ondary child abuse and neglect prevention activities; 4 (3) promising practices of Indian Tribes with 5 respect to child abuse and neglect prevention that 6 are culturally based or culturally adapted; 7 (4) information and recommendations on how 8 such culturally based or culturally adapted child 9 abuse and neglect prevention activities could become 10 evidence-based; 11 (5) the number of Indian Tribes that have 12 accessed Federal child abuse and neglect prevention 13 programs; 14 (6) child abuse and neglect prevention activities 15 that Indian Tribes provide using of State funds; 16 (7) child abuse and neglect prevention activities 17 that Indian tribes provide using Tribal funds; 18 (8) Tribal access to State children’s trust fund 19 resources; 20 (9) how the children’s trust fund model could 21 be used to support prevention efforts regarding child 22 abuse and neglect of American Indian and Alaska 23 Native children; 24 VerDate Sep 11 2014 02:33 May 14, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 \\ALPHA3\E\BILLS\H2549.IH H2549 kjohnson on DSK79L0C42 with BILLS 4 •HR 2549 IH (10) Federal agency technical assistance efforts 1 to address child abuse and neglect prevention and 2 treatment of American Indian and Alaska Native 3 children; 4 (11) Federal agency cross-system collaboration 5 to address child abuse and neglect prevention and 6 treatment of American Indian and Alaska Native 7 children; 8 (12) Tribal access to child abuse and neglect 9 prevention research and demonstration grants under 10 the Child Abuse Prevention and Treatment Act (42 11 U.S.C. 5101 et seq.); 12 (13) an examination of Federal child abuse and 13 neglect data systems to identify what Tribal data is 14 being submitted and barriers to submitting data; 15 and 16 (14) an examination of Federal child abuse and 17 neglect data systems to identify recommendations on 18 improving the collection of data from Indian Tribes. 19 SEC. 3. OTHER AMENDMENTS. 20 (a) GEOGRAPHICAL DISTRIBUTION.—Section 108(b) 21 of the Child Abuse Prevention and Treatment Act (42 22 U.S.C. 5106d(b)) is amended by inserting ‘‘Indian tribes, 23 and tribal organizations,’’ after ‘‘the States,’’. 24 VerDate Sep 11 2014 02:33 May 14, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 \\ALPHA3\E\BILLS\H2549.IH H2549 kjohnson on DSK79L0C42 with BILLS 5 •HR 2549 IH (b) ALLOCATION OF AMOUNTS.—Section 203 of the 1 Child Abuse Prevention and Treatment Act (42 U.S.C. 2 5116b) is amended— 3 (1) by striking ‘‘section 210’’ each place it ap- 4 pears and inserting ‘‘section 209’’; and 5 (2) in subsection (a)— 6 (A) by striking ‘‘The Secretary’’ and in- 7 serting the following: 8 ‘‘(1) IN GENERAL.—Subject to paragraph (2), 9 the Secretary’’; and 10 (B) by adding at the end the following: 11 ‘‘(2) ALLOTMENT FOR INCREASED APPROPRIA- 12 TION YEARS.—In any fiscal year for which the 13 amount appropriated under section 209 exceeds the 14 amount appropriated under such section for fiscal 15 year 2018 by more than $1,000,000, the Secretary 16 shall reserve— 17 ‘‘(A) 5 percent of the amount appropriated 18 for the applicable fiscal year to make allotments 19 to Indian tribes and tribal organizations; and 20 ‘‘(B) 1 percent of the amount appropriated 21 for the applicable fiscal year to make allotments 22 to migrant programs.’’. 23 Æ VerDate Sep 11 2014 02:33 May 14, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 \\ALPHA3\E\BILLS\H2549.IH H2549 kjohnson on DSK79L0C42 with BILLS
