SHORT TITLE. 3 This Act may be cited as the ‘‘National Advisory 4 Council on Indian Education Improvement Act’’ or the 5 ‘‘NACIE Improvement Act’’. 6 SEC. 2. NATIONAL ADVISORY COUNCIL ON INDIAN EDU- 7 CATION. 8 (a) MEMBERSHIP OF NACIE.—By not later than 9 180 days after the date of enactment of this Act and not- 10 withstanding any other provision of section 6141 of the 11 Elementary and Secondary Education Act of 1965 (20 12 U.S.C. 7471), the President shall ensure that the National 13 Advisory Council on Indian Education established under 14 such section includes at least one member who is a presi- 15 dent of a Tribal College or University (as defined in sec- 16 tion 316(b) of the Higher Education Act of 1965 (20 17 U.S.C. 1059c(b)). 18 (b) CONSIDERATION OF REPORTS.— 19 (1) SHARING OF REPORT WITH SECRETARIES 20 OF EDUCATION AND INTERIOR.—By not later than 21 June 30 of each year, the National Advisory Council 22 on Indian Education shall provide the NACIE an- 23 nual report submitted to Congress under section 24 6141(b)(3) of the Elementary and Secondary Edu- 25 3 † S 749 ES cation Act of 1965 (20 U.S.C. 7471(b)(3)) for such 1 year to the Secretary of Education and the Sec- 2 retary of the Interior. 3 (2) DEPARTMENT OF EDUCATION.—The Sec- 4 retary of Education, in preparing the budget mate- 5 rials submitted to Congress by the Secretary in sup- 6 port of the budget of the United States Government 7 that is submitted under section 1105 of title 31, 8 United States Code, shall consider the most recent 9 NACIE annual report. 10 (3) DEPARTMENT OF THE INTERIOR.—The 11 Secretary of the Interior, in consultation with the 12 Education Subcommittee of the Tribal-Interior 13 Budget Council, in preparing the budget materials 14 submitted to Congress by the Secretary of the Inte- 15 rior in support of the budget of the United States 16 Government that is submitted under section 1105 of 17 title 31, United States Code, shall consider the most 18 recent NACIE annual report. 19 (c) DEFINITION.—In this section, the term ‘‘NACIE 20 annual report’’ means the report prepared under section 21 4 † S 749 ES 6141(b)(3) of the Elementary and Secondary Education 1 Act of 1965 (20 U.S.C. 7471(b)(3)). 2 Passed the Senate November 8, 2023.
