SHORT TITLE. 1 This Act may be cited as the ‘‘Full Utilization of the 2 Harbor Maintenance Trust Fund Act’’. 3 SEC. 2. USE OF HARBOR MAINTENANCE TRUST FUND TO 4 SUPPORT NAVIGATION. 5 Section 210 of the Water Resources Development Act 6 of 1986 (33 U.S.C. 2238) is amended— 7 (1) in the section heading, by striking ‘‘AU- 8 THORIZATION OF APPROPRIATIONS’’ and insert- 9 ing ‘‘FUNDING FOR NAVIGATION’’; and 10 (2) by adding at the end the following: 11 ‘‘(g) ADJUSTMENTS TO DISCRETIONARY SPENDING 12 LIMITS.—Amounts made available from the Harbor Main- 13 tenance Trust Fund under this section or section 9505 14 of the Internal Revenue Code of 1986 shall be made avail- 15 able in accordance with section 251(b)(2)(H) of the Bal- 16 anced Budget and Emergency Deficit Control Act of 17 1985.’’. 18 SEC. 3. ANNUAL REPORT TO CONGRESS. 19 Section 330 of the Water Resources Development Act 20 of 1992 (26 U.S.C. 9505 note; 106 Stat. 4851) is amend- 21 ed— 22 (1) in subsection (a)— 23 (A) by striking ‘‘and annually thereafter,’’ 24 and inserting ‘‘and annually thereafter concur- 25 VerDate Sep 11 2014 00:17 Oct 30, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2440.RFS H2440 kjohnson on DSK79L0C42 with BILLS 3 HR 2440 RFS rent with the submission of the President’s an- 1 nual budget request to Congress,’’; and 2 (B) by striking ‘‘Public Works and Trans- 3 portation’’ and inserting ‘‘Transportation and 4 Infrastructure’’; and 5 (2) in subsection (b)(1) by adding at the end 6 the following: 7 ‘‘(D) A description of the expected expend- 8 itures from the trust fund to meet the needs of 9 navigation for the fiscal year of the budget re- 10 quest.’’. 11 SEC. 4. HARBOR MAINTENANCE TRUST FUND DISCRE- 12 TIONARY SPENDING LIMIT ADJUSTMENT. 13 Section 251(b)(2) of the Balanced Budget and Emer- 14 gency Deficit Control Act of 1985 (2 U.S.C. 901(b)(2)) 15 is amended by adding at the end the following: 16 ‘‘(H) HARBOR MAINTENANCE TRUST 17 FUND.— 18 ‘‘(i) IN GENERAL.—If a bill or joint 19 resolution making appropriations for a fis- 20 cal year is enacted that specifies an 21 amount for harbor maintenance activities, 22 then the adjustments for that fiscal year 23 shall be the total of such amount in that 24 Act for such purpose for that fiscal year, 25 VerDate Sep 11 2014 00:17 Oct 30, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2440.RFS H2440 kjohnson on DSK79L0C42 with BILLS 4 HR 2440 RFS but may not exceed the total amount with- 1 in the Harbor Maintenance Trust Fund 2 under subsection (a) of section 9505 of the 3 Internal Revenue Code of 1986 on the last 4 day of the fiscal year that is 2 years prior 5 to that fiscal year. 6 ‘‘(ii) LIMITATION.—The adjustment 7 under clause (i) with respect to an amount 8 made available for harbor maintenance ac- 9 tivities may only be made if such 10 amount— 11 ‘‘(I) is derived solely from funds 12 in such Trust Fund; and 13 ‘‘(II) is made available for ex- 14 penditures described under subsection 15 (c) of such section 9505.’’. 16 Passed the House of Representatives October 28, 2019.
