Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. ENERGY TECHNOLOGY MATURATION PROGRAM. 1 (a) IN GENERAL.—Title X of the Energy Policy Act 2 of 2005 (42 U.S.C. 16391 et seq.) is amended by adding 3 at the end the following: 4 ‘‘SEC. 1012. ENERGY TECHNOLOGY MATURATION PROGRAM. 5 ‘‘(a) DEFINITIONS.—In this section: 6 ‘‘(1) DEPARTMENT FACILITY.—The term ‘De- 7 partment facility’ includes— 8 ‘‘(A) a National Laboratory; 9 ‘‘(B) any plant or site of the Department 10 (such as the Kansas City National Security 11 Campus, the Nevada National Security Site, the 12 Pantex Plant, and the Y–12 National Security 13 Complex); and 14 ‘‘(C) any partnership of entities described 15 in subparagraphs (A) and (B). 16 ‘‘(2) PROGRAM.—The term ‘program’ means 17 the Energy Technology Maturation Program estab- 18 lished under subsection (b). 19 ‘‘(b) ESTABLISHMENT.—The Secretary shall estab- 20 lish a program, to be known as the ‘Energy Technology 21 Maturation Program’, under which the Secretary shall 22 provide funding to Department facilities to facilitate the 23 commercialization of energy and related technologies 24 that— 25 VerDate Sep 11 2014 04:03 May 09, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2495.IH H2495 kjohnson on DSK79L0C42 with BILLS 3 •HR 2495 IH ‘‘(1) exhibit promising commercial potential; 1 and 2 ‘‘(2) are developed at Department facilities. 3 ‘‘(c) USE OF FUNDS.—A Department facility shall 4 use funding provided under the program— 5 ‘‘(1) to carry out additional development activi- 6 ties on any technology developed at the Department 7 facility to advance the state of the technology to the 8 degree that a private sector partner would be inter- 9 ested in supporting commercialization of the tech- 10 nology; or 11 ‘‘(2) in any case in which a private sector part- 12 ner has been identified and the identified private 13 sector partner has executed or will execute a tech- 14 nology partnership agreement, to support coopera- 15 tive development of a technology developed at the 16 Department facility for a specific commercial appli- 17 cation of the technology. 18 ‘‘(d) APPLICATIONS.— 19 ‘‘(1) IN GENERAL.—To be eligible to receive 20 funding under the program, a Department facility 21 shall submit to the Secretary an application at such 22 time, in such manner, and containing such informa- 23 tion as the Secretary may require. 24 VerDate Sep 11 2014 04:03 May 09, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2495.IH H2495 kjohnson on DSK79L0C42 with BILLS 4 •HR 2495 IH ‘‘(2) INCLUSIONS.—An application under this 1 subsection shall— 2 ‘‘(A) include a description of— 3 ‘‘(i) the potential impact on markets if 4 the applicable technology is successfully 5 commercialized; 6 ‘‘(ii) the intended accomplishments of 7 the project proposed to be carried out 8 using the funding with respect to advanc- 9 ing the maturity and commercial potential 10 of the applicable technology; and 11 ‘‘(iii) a project plan, including a de- 12 scription of each activity required to be 13 carried out to accomplish the specific ob- 14 jectives of the project; and 15 ‘‘(B) demonstrate to the satisfaction of the 16 Secretary that each Department facility and 17 private sector partner involved in the proposed 18 project, and any other resource required to 19 carry out the project, is qualified and capable 20 of successfully completing, and is available to 21 complete, the project, including a description of 22 the roles and responsibilities proposed to be 23 carried out. 24 VerDate Sep 11 2014 04:03 May 09, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2495.IH H2495 kjohnson on DSK79L0C42 with BILLS 5 •HR 2495 IH ‘‘(3) MULTIPLE PROJECTS.—A Department fa- 1 cility may submit to the Secretary an application for 2 one or more technology maturation projects under 3 the program. 4 ‘‘(4) APPROVAL BY SECRETARY.— 5 ‘‘(A) IN GENERAL.—The Secretary shall 6 develop criteria for evaluating applications 7 under this subsection, which may include— 8 ‘‘(i) the potential that a proposed 9 technology will result in a commercially 10 successful product within a reasonable 11 timeframe; 12 ‘‘(ii) the relative maturity of a pro- 13 posed technology for commercial applica- 14 tion; and 15 ‘‘(iii) the proposed technical approach 16 and capability of the Department facilities 17 and private sector partners to successfully 18 implement a project. 19 ‘‘(B) PRIORITY.—In selecting applicants to 20 receive funding under the program, the Sec- 21 retary shall give priority to an application sub- 22 mitted by a partnership between— 23 ‘‘(i) a Department facility; and 5 ‘‘(2) $750,000 for an activity described in sub- 6 section (c)(2). 7 ‘‘(f) COST-SHARING REQUIREMENTS.—The cost- 8 sharing requirements of the program, including require- 9 ments relating to in-kind contributions, shall be deter- 10 mined by the Secretary in accordance with section 988. 11 ‘‘(g) FUNDING.—The Secretary may use to carry out 12 the program— 13 ‘‘(1) amounts in the Energy Technology Com- 14 mercialization Fund established under section 15 1001(e); or 16 ‘‘(2) any other amounts made available to sup- 17 port technology transfer within the Department. 18 ‘‘(h) ANNUAL REPORT.—The Secretary shall include 19 in the annual report required under section 1001(g)(2) a 20 description of the results of the technology maturation 21 projects carried out under the program.’’. 22 (b) TABLE OF CONTENTS.—The table of contents of 23 the Energy Policy Act of 2005 (Public Law 109–58;
