SHORT TITLE. 1 This Act may be cited as the ‘‘National Law Enforce- 2 ment Museum Commemorative Coin Act’’. 3 SEC. 2. FINDINGS. 4 The Congress finds the following: 5 (1) In 2000, Congress passed and President 6 William J. Clinton signed into law the National Law 7 Enforcement Museum Act (Public Law 106–492), 8 which authorized the National Law Enforcement Of- 9 ficers Memorial Fund, Inc. to build the National 10 Law Enforcement Museum on Federal land in the 11 District of Columbia to honor and commemorate the 12 service and sacrifice of law enforcement officers in 13 the United States. 14 (2) In April 2016, construction began on the 15 National Law Enforcement Museum in the District 16 of Columbia across the street from the National Law 17 Enforcement Officers Memorial in Judiciary Square. 18 (3) The National Law Enforcement Museum 19 formally opened on October 13, 2018. 20 (4) The National Law Enforcement Museum’s 21 mission is— 22 (A) to honor and commemorate the ex- 23 traordinary service and sacrifice of America’s 24 law enforcement officers; 25 VerDate Sep 11 2014 03:14 May 07, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1300.IS S1300 kjohnson on DSK79L0C42 with BILLS 3 •S 1300 IS (B) to serve as an important bridge be- 1 tween law enforcement’s past and present, be- 2 tween the heroes of yesteryear and those who 3 have followed in their footsteps, and between 4 America’s peace officers and the public they 5 serve; and 6 (C) increase public understanding and sup- 7 port for law enforcement and to promote law 8 enforcement safety. 9 SEC. 3. COIN SPECIFICATIONS. 10 (a) DENOMINATIONS.—The Secretary of the Treas- 11 ury (hereafter in this Act referred to as the ‘‘Secretary’’) 12 shall mint and issue the following coins: 13 (1) $5 GOLD COINS.—Not more than 50,000 $5 14 coins, which shall— 15 (A) weigh 8.359 grams; 16 (B) have a diameter of 0.850 inches; and 17 (C) contain not less than 90 percent gold. 18 (2) $1 SILVER COINS.—Not more than 400,000 19 $1 coins, which shall— 20 (A) weigh 26.73 grams; 21 (B) have a diameter of 1.500 inches; and 22 (C) contain not less than 90 percent silver. 23 (3) HALF-DOLLAR CLAD COINS.—Not more 24 than 750,000 half-dollar coins which shall— 25 VerDate Sep 11 2014 03:14 May 07, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1300.IS S1300 kjohnson on DSK79L0C42 with BILLS 4 •S 1300 IS (A) weigh 11.34 grams; 1 (B) have a diameter of 1.205 inches; and 2 (C) be minted to the specifications for half- 3 dollar coins contained in section 5112(b) of title 4 31, United States Code. 5 (b) LEGAL TENDER.—The coins minted under this 6 Act shall be legal tender, as provided in section 5103 of 7 title 31, United States Code. 8 (c) NUMISMATIC ITEMS.—For purposes of section 9 5134 of title 31, United States Code, all coins minted 10 under this Act shall be considered to be numismatic items. 11 SEC. 4. DESIGN OF COINS. 12 (a) DESIGN REQUIREMENTS.— 13 (1) IN GENERAL.—The design of the coins 14 minted under this Act shall be emblematic of the 15 National Law Enforcement Museum and the service 16 and sacrifice of law enforcement officers throughout 17 the history of the United States. 18 (2) DESIGNATION AND INSCRIPTIONS.—On 19 each coin minted under this Act there shall be— 20 (A) a designation of the value of the coin; 21 (B) an inscription of the year ‘‘2021’’; and 22 (C) inscriptions of the words ‘‘Liberty’’, 23 ‘‘In God We Trust’’, ‘‘United States of Amer- 24 ica’’, and ‘‘E Pluribus Unum’’. 25 VerDate Sep 11 2014 03:14 May 07, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1300.IS S1300 kjohnson on DSK79L0C42 with BILLS 5 •S 1300 IS (b) SELECTION.—The design for the coins minted 1 under this Act shall be— 2 (1) selected by the Secretary after consultation 3 with the Commission of Fine Arts and the National 4 Law Enforcement Officers Memorial Fund, Inc.; and 5 (2) reviewed by the Citizens Coinage Advisory 6 Committee. 7 SEC. 5. ISSUANCE OF COINS. 8 (a) QUALITY OF COINS.—Coins minted under this 9 Act shall be issued in uncirculated and proof qualities. 10 (b) MINT FACILITIES.—Only 1 facility of the United 11 States Mint may be used to strike any particular quality 12 of the coins minted under this Act. 13 (c) PERIOD FOR ISSUANCE.—The Secretary may 14 issue coins minted under this Act only during the 1-year 15 period beginning on January 1, 2021. 16 SEC. 6. SALE OF COINS. 17 (a) SALE PRICE.—The coins issued under this Act 18 shall be sold by the Secretary at a price equal to the sum 19 of— 20 (1) the face value of the coins; 21 (2) the surcharge provided in section 7(a) with 22 respect to such coins; and 23 VerDate Sep 11 2014 03:14 May 07, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S1300.IS S1300 kjohnson on DSK79L0C42 with BILLS 6 •S 1300 IS (3) the cost of designing and issuing the coins 1 (including labor, materials, dies, use of machinery, 2 overhead expenses, marketing, and shipping). 3 (b) BULK SALES.—The Secretary shall make bulk 4 sales of the coins issued under this Act at a reasonable 5 discount. 6 (c) PREPAID ORDERS.— 7 (1) IN GENERAL.—The Secretary shall accept 8 prepaid orders for the coins minted under this Act 9 before the issuance of such coins. 10 (2) DISCOUNT.—Sale prices with respect to pre- 11 paid orders under paragraph (1) shall be at a rea- 12 sonable discount. 13 SEC. 7. SURCHARGES. 14 (a) IN GENERAL.—All sales of coins issued under this 15 Act shall include a surcharge of— 16 (1) $35 per coin for the $5 coin; 17 (2) $10 per coin for the $1 coin; and 18 (3) $5 per coin for the half-dollar coin. 19 (b) DISTRIBUTION.—Subject to section 5134(f)(1) of 20 title 31, United States Code, all surcharges received by 21 the Secretary from the sale of coins issued under this Act 22 shall be promptly paid by the Secretary to the National 23 Law Enforcement Officers Memorial Fund, Inc., for edu- 24 cational and outreach programs and exhibits. 25 VerDate Sep 11 2014 03:14 May 07, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\S1300.IS S1300 kjohnson on DSK79L0C42 with BILLS 7 •S 1300 IS (c) AUDITS.—The National Law Enforcement Offi- 1 cers Memorial Fund, Inc., shall be subject to the audit 2 requirements of section 5134(f)(2) of title 31, United 3 States Code, with regard to the amounts received under 4 subsection (b). 5 (d) LIMITATION.—Notwithstanding subsection (a), 6 no surcharge may be included with respect to the issuance 7 under this Act of any coin during a calendar year if, as 8 of the time of such issuance, the issuance of such coin 9 would result in the number of commemorative coin pro- 10 grams issued during such year to exceed the annual 2 11 commemorative coin program issuance limitation under 12 section 5112(m)(1) of title 31, United States Code (as in 13 effect on the date of the enactment of this Act).
