SUBSTANCE MISUSE PREVENTION AND TREATMENT 1 GRANTS FOR INSTITUTIONS OF HIGHER EDU- 2 CATION. 3 Section 120(e) of the Higher Education Act of 1965 4 (20 U.S.C. 1011i(e)) is amended to read as follows: 5 ‘‘(e) SUBSTANCE MISUSE PREVENTION AND TREAT- 6 MENT GRANTS FOR INSTITUTIONS OF HIGHER EDU- 7 CATION.— 8 ‘‘(1) PURPOSES.—The purposes of this grant 9 program are to— 10 ‘‘(A) address the effect of substance mis- 11 use on students enrolled in higher education; 12 ‘‘(B) prevent students enrolled in higher 13 education from developing a substance use dis- 14 order; 15 ‘‘(C) educate faculty and other staff about 16 the warning signs of substance use disorders 17 and how to help students who are affected by 18 such disorders; and 19 ‘‘(D) identify and promote evidence-based 20 and promising practices for helping to prevent 21 and address substance use disorders among stu- 22 dents enrolled in higher education. 23 ‘‘(2) DEFINITIONS.—In this subsection: 24 ‘‘(A) EVIDENCE-BASED.—The term ‘evi- 25 dence-based’, when used with respect to a pro- 26 VerDate Sep 11 2014 04:19 May 04, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1281.IS S1281 kjohnson on DSK79L0C42 with BILLS 3 •S 1281 IS gram or practice, means a program or practice 1 that— 2 ‘‘(i) is demonstrated to be effective 3 when implemented with fidelity; 4 ‘‘(ii) is based on a clearly articulated 5 and empirically supported theory; 6 ‘‘(iii) has measurable outcomes rel- 7 evant to substance use disorder prevention, 8 treatment, and recovery, including a de- 9 tailed description of the outcomes produced 10 in a particular population; 11 ‘‘(iv) has been scientifically tested and 12 proven effective through randomized con- 13 trol studies or comparison group studies; 14 and 15 ‘‘(v) has the ability to replicate and 16 scale. 17 ‘‘(B) PROMISING.—The term ‘promising’, 18 when used with respect to a program or prac- 19 tice, means a program or practice that— 20 ‘‘(i) is demonstrated to be effective 21 based on positive outcomes relevant to sub- 22 stance use disorder prevention or treat- 23 ment from one or more objective, inde- 24 pendent, and scientifically valid evalua- 25 VerDate Sep 11 2014 04:19 May 04, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1281.IS S1281 kjohnson on DSK79L0C42 with BILLS 4 •S 1281 IS tions, as documented in writing to the Sec- 1 retaries; and 2 ‘‘(ii) will be evaluated through a well- 3 designed and rigorous study, as described 4 in subparagraph (A)(iv). 5 ‘‘(C) SECRETARIES.—The term ‘Secre- 6 taries’ means the Secretary of Education and 7 the Secretary of Health and Human Services 8 (acting through the Assistant Secretary for 9 Mental Health and Substance Use). 10 ‘‘(D) SUBSTANCE USE.—The term ‘sub- 11 stance use’ may include the misuse or abuse of 12 alcohol, prescription opioids, methamphetamine, 13 or other legal or illegal substances. 14 ‘‘(3) PROGRAM AUTHORIZED.— 15 ‘‘(A) IN GENERAL.—The Secretaries, in 16 accordance with the interagency agreement de- 17 scribed in paragraph (4), may award, on a com- 18 petitive basis, grants to institutions of higher 19 education, or consortia of institutions of higher 20 education, with regional high incidences of sub- 21 stance use disorders, overdoses, and deaths, in 22 order to prevent and address the effects of sub- 23 stance use on the campuses of the institutions 24 of higher education. 25 VerDate Sep 11 2014 04:19 May 04, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1281.IS S1281 kjohnson on DSK79L0C42 with BILLS 5 •S 1281 IS ‘‘(B) DURATION.—A grant under this sub- 1 section shall be for a period of not more than 2 5 years, and may be renewed for an additional 3 2 years if satisfactory progress is made in pre- 4 venting and reducing substance use disorders as 5 described in paragraph (5)(A). 6 ‘‘(C) RESERVATION FOR RURAL AREAS.— 7 The Secretaries shall ensure that at least 25 8 percent of funds are awarded to rural-serving 9 institutions of higher education, as defined in 10 section 861. 11 ‘‘(4) INTERAGENCY AGREEMENT.—The Sec- 12 retary of Education and the Secretary of Health and 13 Human Services, acting through the Assistant Sec- 14 retary of Mental Health and Substance Use, shall 15 jointly administer the program under this subsection 16 in accordance with such terms as the Secretaries set 17 forth in an interagency agreement. Such interagency 18 agreement shall include a description of the respec- 19 tive roles and responsibilities of the Secretaries (both 20 jointly and separately). 21 ‘‘(5) APPLICATION.—An institution of higher 22 education, or consortium of institutions of higher 23 education, desiring a grant under paragraph (3)(A) 24 shall submit an application at such time and in such 25 VerDate Sep 11 2014 04:19 May 04, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S1281.IS S1281 kjohnson on DSK79L0C42 with BILLS 6 •S 1281 IS manner as the Secretaries may require. Such appli- 1 cation shall include— 2 ‘‘(A) a description of the impact of sub- 3 stance use disorders on students enrolled in 4 each participating institution of higher edu- 5 cation, including— 6 ‘‘(i) the number of overdoses in the 7 past year; 8 ‘‘(ii) the number of deaths related to 9 substance use in the past year; 10 ‘‘(iii) the degree to which students 11 have substance use disorders, if such infor- 12 mation is available; and 13 ‘‘(iv) other indicators or information 14 related to the most prevalent substance use 15 in the region that such institution feels is 16 necessary to fully describe the impact of 17 the substance use on students; 18 ‘‘(B) an assurance that the institution of 19 higher education, or consortia of institutions, 20 has convened a taskforce to address the impact 21 of the most prevalent substance use in the re- 22 gion on students, which shall include— 23 ‘‘(i) faculty and other staff; 3 ‘‘(iii) staff from campus health cen- 4 ters, if the institution operates campus 5 health centers; 6 ‘‘(iv) representatives from campus dis- 7 ability support services offices and student 8 access support offices, if such offices exist 9 at the institution; 10 ‘‘(v) representatives from fraternities 11 and sororities, if such organizations exist 12 at the institution; 13 ‘‘(vi) area local educational agencies; 14 ‘‘(vii) local nonprofit organizations 15 specializing in substance use treatment 16 and prevention, including drug-free com- 17 munities grantees under chapter 2 of sub- 18 title A of title I of the Anti-Drug Abuse 19 Act of 1988 (21 U.S.C. 1521 et seq.); 2 ‘‘(C) a plan developed by the taskforce de- 3 scribed in subparagraph (B) to use funds in ac- 4 cordance with paragraph (6) to address the im- 5 pact of substance use on students enrolled in 6 higher education, which shall include a descrip- 7 tion of— 8 ‘‘(i) the goals of the project, which 9 shall include decreasing the number of stu- 10 dents with substance use disorders; and 11 ‘‘(ii) how the institution or consortium 12 will— 13 ‘‘(I) use funds in accordance with 14 paragraph (6), including the evidence 15 base for proposed activities; 16 ‘‘(II) coordinate funds with other 17 programs designed to prevent and ad- 18 dress substance use disorders among 19 students; and 20 ‘‘(III) sustain grant activities be- 21 yond the grant period, including 22 methods for continuous improvement 23 of grant activities; and 24 VerDate Sep 11 2014 04:19 May 04, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\S1281.IS S1281 kjohnson on DSK79L0C42 with BILLS 9 •S 1281 IS ‘‘(D) an assurance that the institution or 1 consortium will continue to convene the 2 taskforce described in subparagraph (B) peri- 3 odically to improve institutional programming 4 and policy related to substance use disorders. 5 ‘‘(6) USES OF FUNDS.— 6 ‘‘(A) REQUIRED ACTIVITIES.—An institu- 7 tion of higher education, or consortium of insti- 8 tutions of higher education, receiving a grant 9 under paragraph (3) shall use grant funds for 10 evidence-based or promising interventions de- 11 signed to address and prevent substance use 12 disorders among students enrolled in higher 13 education. 14 ‘‘(B) ALLOWABLE ACTIVITIES.—The activi- 15 ties described in subparagraph (A) may in- 16 clude— 17 ‘‘(i) education efforts to provide stu- 18 dents enrolled in higher education with in- 19 formation on the impact of substance use 20 disorders; 2 ‘‘(iii) treatment or referrals to treat- 3 ment for such students with substance use 4 disorders; 5 ‘‘(iv) institution-wide prevention ef- 6 forts, which may include public service an- 7 nouncements; 8 ‘‘(v) efforts to identify programs tar- 9 geting populations of students, such as 10 student athletes, fraternity members, so- 11 rority members, and others enrolled in 12 higher education, with an increased risk 13 for substance use disorders; 14 ‘‘(vi) mental or behavioral health 15 counseling or academic counseling services 16 for students enrolled in higher education 17 who are affected by substance use dis- 18 orders; and 19 ‘‘(vii) other programs designed to ad- 20 dress or prevent substance use disorders 21 among students enrolled in higher edu- 22 cation. 23 ‘‘(7) SUPPLEMENT NOT SUPPLANT.—Funds 24 made available under this subsection shall be used to 25 VerDate Sep 11 2014 04:19 May 04, 2019 Jkt 089200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\S1281.IS S1281 kjohnson on DSK79L0C42 with BILLS 11 •S 1281 IS supplement and not supplant other Federal, State, 1 and local funds available to the institution to carry 2 out the activities described in paragraph (6). 3 ‘‘(8) MATCHING REQUIREMENT.—An institution 4 of higher education, or consortium of institutions of 5 higher education, receiving a grant under paragraph 6 (3) shall provide, from non-Federal sources, not less 7 than 20 percent of matching funds, which may be in 8 cash or in-kind contributions. 9 ‘‘(9) NATIONAL ACTIVITIES.— 10 ‘‘(A) IN GENERAL.—The Secretaries may 11 reserve not more than 5 percent of funds made 12 available under paragraph (10) to— 13 ‘‘(i) conduct a rigorous, independent 14 evaluation of each grant funded under this 15 Act, particularly its impact on the indica- 16 tors described in paragraph (5)(A); 17 ‘‘(ii) disseminate and promote the uti- 18 lization of evidence-based or promising 19 practices regarding substance use disorder 20 prevention and treatment for students en- 21 rolled in higher education;
